Print | Single Page[-] Text [+] NEW YORK, March 1 (Reuters Legal) - A banana peel, the torment of many a cartoon character, has allegedly become the real-life downfall of a woman in California. Ida Valentine, 58, is suing the 99 Cents Only store where she slipped on one last April.

She said that she suffered a herniated disk and tissue damage, spent $9,000 on medical bills and is seeking an unspecified amount in damages.

"She fell and landed on her backside," said Courtney Mikolaj of the Quirk Law Firm in Ventura, California, which is representing her.

Mikolaj said the 99 Cents Only store in Fontana, California, refused a proposed settlement of $44,000. Executives from the company, a deep-discount retailer with hundreds of stores in western states, were not immediately available for comment.

The image in popular culture of an unwary pedestrian tripping head over heels on a banana peel stems from the late 19th century, when bananas were a popular street food in American cities and the press portrayed them as a public nuisance.

In 1879, Harper's Weekly groused that "whosoever throws banana skins on the sidewalk does a great unkindness to the public, and is quite likely to be responsible for a broken limb."

Ouch!! Poor lady. I'm wondering though how much she is asking for? It appears that the store is trying to be reasonable.

Ouch? No. Probably a usual scheme of making money of poor store owners. I would have paid only for her medical bills. Nothing more.

And we wonder why this country is going bankrupt. We sue for anything, where does this money come from? Who than pays for all these court cases? Having said that, doesn't mean the woman is wrong, but do we need more than what is really needed to pay for the medical expenses?

Why only .99 cents? Didn't she have medical bills? This is what they should be responsible for!!

And furthermore ... I doubt that the store put the peeling there. She should sue the person who put it on the floor but not the store.

If the description of her physical injuries are accurate this herniated disc could profoundly affect her latter years. Will it have to be fused, will she walk stooped over? Isn't this truly what insurance is for? 44K might not be to far off the mark. Maybe the discount chain is balking at having to hire banana-police and how it will affect the bottom line!

Woody makes a good point. If this store doesn't sell banana's than how did the peel get there? Someone eating the banana most have dropped it there and they should be held accountable or did the person themselves do this to get the money? Its bad enough when you see all the garbage people throw out of the window's of there cars, and on the streets, etc. Now they are throwing there garbage down inside of stores.

Lawsuits are not always that simple as someone trying to get as much as they can for a minor issue.

My knee problems began with a fall in my back yard.Following knee replacement surgery I was contacted both by my supplemental and medicare and asked to fill out a form.

Had my injury occurred somewhere else and/or because of a fall on a bannana peel where it should not hve been they would not have paid. I would have had to give full details and then go after them.

I am hip replacement surgery on tues. This also stems from a previous injury. Had I slipped on a bannana peel in a store they/I would have to go after them for payment.

My mother had a terrible fall in our yard and was off work for sometime because of her injured knee. Her insurance would not pay as it happened on our property. Because she was a relative,even tho she did not live with, us our insurance would not pay without a lawsuit forcing them to do so.

Because it was my mother she was not going to.Then we saw the bill and there was no way she or we could pay.

He pain and inability to do thins as easily as before was diminished. Sometimes causing her to miss work.This was sometime later. Who should have paid for that?

They probably didn't but the store owner and employee's are responsible for making the premises safe.

Yes, that is what the store offered, but she refused it. I was wondering how much more she was asking for. It appeared that the store was trying to be reasonable without being sued for it; I'm just wondering if she is asking for millions now.
