Former President Trump's interview with TIME — out this morning — was chock-full of examples of how a second Trump administration would challenge longstanding U.S. norms and laws, Axios' Erin Doherty writes.

  1. Trump claimed undocumented immigrants "aren't civilians" and wouldn't be protected by the law that forbids the use of the military against civilians. (This runs against how people in the U.S. get due process.)
  2. Trump wouldn't rule out violence if he loses in November: "It always depends on the fairness of the election."
  3. Trump said it's up to the states if they decide to monitor women's pregnancies, and it's up to the states to decide whether to prosecute women for getting abortions after a ban.
  4. Trump floated the retreat of U.S. forces from South Korea if the U.S. ally doesn't pay up.
  5. Trump said he'd "absolutely" consider pardoning Jan. 6 defendants.

What would a second Trump term really look like? You no longer need to guess:

  • Former President Trump has laid out, publicly and unambiguously, designs to stretch traditions, norms and accepted law in historic ways, Jim VandeHei and Mike Allen write.

Why it matters: We've written for months that Trump allies privately are plotting loyalty tests and policy proposals to vastly expand presidential power and punish critics.

  • Trump himself is now saying the quiet part out loud. You should listen.

You might like this or loathe it. But, based on two interviews with TIME magazine totaling more than 80 minutes, you can no longer ignore Trump's intentions:

  1. On whether states should monitor women's pregnancies so they can know if they've gotten an abortion that violates a ban (say, after 15 weeks of pregnancy): "I think they might do that. Again, you'll have to speak to the individual states." (President Biden tweeted about that quote: "This is reprehensible.")
  2. On political violence in connection with the upcoming election: "I don't think we're going to have that. I think we're going to win. And if we don't win, you know, it depends. It always depends on the fairness of an election."
  3. On using the military to deport migrants who cross illegally: "Well, these aren't civilians. These are people that aren't legally in our country. This is an invasion of our country."
  4. On launching the largest deportation operation in American history: "Because we have no choice. I don't believe this is sustainable for a country, what's happening to us."
  5. On using the military against protesters: "I would use certainly the National Guard, if the police were unable to stop. I would absolutely use the National Guard." He then mentioned an executive order he signed to encourage prosecution of anyone who desecrates national monuments.
  6. On using Schedule F power to fire civil servants: "You have some people that are protected that shouldn't be protected. And you have some people you almost want to protect because they do such a good job."
  7. On pardoning every one of the people convicted of participating in the Jan. 6 attack on the U.S. Capitol: "I would consider that, yes. ... Yes, absolutely."
  8. On whether he might fire a U.S. attorney who didn't prosecute someone on his orders: "It would depend on the situation. Yeah."
  9. On "anti-white racism" protections: "I think there is a definite anti-white feeling in this country, and that can't be allowed."
  10. On disbanding the White House Office of Pandemic Preparedness and Response Policy, established under President Biden: "I think I would. ... I think it sounds good politically, but I think it's a very expensive solution."

Between the lines: TIME, in the cover story going on sale May 17, calls Trump's responses "the outlines of an imperial presidency that would reshape America and its role in the world."

  • Asked by the magazine about his statement on Fox News in December that he'd be a dictator just for Day 1 of his presidency, Trump said: "I think a lot of people like it."

The bottom line: President Biden has been vaguer about his second-term plans. But voters now have a clear policy, philosophical and stylistic choice.

'24 split screen

Vice President Kamala Harris slammed the "Trump abortion ban" during a speech today in Florida, while former President Trump focused his fire in Wisconsin on President Biden's handling of the economy.

Why it matters: The dueling speeches underscore the split screen that's likely to play out over the next six months.

In Jacksonville, Florida, Harris invoked Trump's name over 20 times during her speech, CNN reports.

  • Florida's ban on most abortions after six weeks of pregnancy went into effect today.
  • "Across our nation, we witness a full-on assault, state by state, on reproductive freedom," Harris said. "And understand who is to blame: former President Donald Trump did this."
  • Trump has repeatedly claimed credit for the repeal of Roe v. Wade, and told TIME it's up to the states to decide to monitor women's pregnancies to know if they've received an abortion.

In Waukesha, Wisconsin, Trump sought to capitalize on the polling showing voters trust him more on the economy.

  • "With me in the White House, we will protect the Trump tax cuts for working families, we will make our middle class stronger, bigger, better, stronger, wealthier and more prosperous than ever before," Trump said.
  • "We're now in a Biden stagflation," Trump said, "which spells the death of the American dream."

Reality check: "I don't see the stag- or the -flation," Federal Reserve Chair Jerome Powell said during a press conference earlier today.

Robert F. Kennedy Jr. has a novel new argument, claiming it's President Biden who is the real spoiler in 2024.

  • Kennedy challenged Biden to a bizarre "no spoiler pledge," saying whichever of the two men performs weaker in a head-to-head 50-state poll in mid-October with former President Trump should agree to drop out.

Reality check: This won't happen.

  • DNC spokesperson Matt Corridoni, who is leading Democrats' efforts to counter third-party bids, wrote on X that Kennedy is "a spoiler — recruited by the MAGA GOP and propped up by Trump's largest donor."

The big picture: Kennedy has qualified for the 2024 presidential ballot in four states, and the campaign says he has passed the signature threshold in at least half a dozen others, including a couple of swing states.

  • Kennedy's long-shot independent bid has built a robust plan to try to get on the ballot in all 50 states.

After years of calling voting by mail "corrupt" and "crooked," Donald Trump and GOP committees are scrambling to convince their voters that it's safe and secure ahead of the election, Axios' Alex Thompson writes.

  • Why it matters: Democrats have built a large mail-in voting advantage over the GOP in swing states that could decide the election.

Many Republican voters have bought into Trump's distrust of voting by mail.

  • But Trump — who has long cited mail-in voting in questioning the results of the 2020 election — abruptly shifted his public messaging this month.
  • "ABSENTEE VOTING, EARLY VOTING, AND ELECTION DAY VOTING ARE ALL GOOD OPTIONS," he posted on Truth Social.
  • "REPUBLICANS MUST MAKE A PLAN, REGISTER, AND VOTE!"

🔎 Zoom in: In Pennsylvania, three Republican groups spent $1.5 million ahead of last week's primary to organize supporters to vote by mail.

  • The groups will spend at least $8.5 million more on the campaign before November, according to a spokesperson.
  • As part of their messaging, the groups emphasize that members of the military have trusted mail-in voting for decades.
  • Donald Trump Jr. also appears in ads for the effort: "Pennsylvania, I need you to join the mail-in voting list today," he says to the camera, before pointing to a website, SkipTheLinePA.vote.

🥊 Reality check: It might be too late to rebuild the trust in vote-by-mail that Trump tore down after the 2020 election.

  • Trump railed against the practice just two months ago. In Michigan on Feb. 27, he said: "Mail-in voting is totally corrupt ... Get that through your head."

🔭 Zoom out: While the GOP's political apparatus is all-in on mail-in and early voting, the practice is still running into headwinds among some grassroots organizers.

  • Tyler Bowyer, chief operating officer of the student arm of the pro-Trump youth group Turning Point USA, recently said: "We're not trying to encourage more people to get on the early voting list."
  • "If you vote too early, you're basically telling Democrats how many votes they need to win," he said.

Former President Trump is squeezing in two rallies today — one in Wisconsin and one in Michigan — before rushing back to Manhattan for court tomorrow.

  • The New York hush-money trial has largely confined Trump to New York, boxing him into Campaign Tetris — trying to fit in a little bit of politicking into every available opening, Axios' Sophia Cai writes.

✈️ Court isn't in session on Wednesdays or weekends, hence today's midweek doubleheader.

  • Trump doesn't always avail himself of these limited campaign opportunities, though — he spent his one free day last week on the golf course.

📢 Social media and televised rants outside the New York courthouse have helped Trump gain some attention.

  • But his statements in those venues have gotten him into trouble in court, and rallies in actual swing states are much more helpful for his campaign.
  • And Trump himself is getting restless. One campaign official told Axios the team is looking for rally locations in New York, after Trump declared that he wants to have a rally at Madison Square Garden.
  • His team set up a campaign stop last week with about 100 supporters at a construction site after Trump complained that there weren't sufficient crowds outside the courthouse to support him.

President Biden and former President Trump are in hot pursuit of a big — possibly determinative — group of voters who loathe both men.

💡 Why it matters: The bloc of "double haters" has ballooned thanks to the surge in Biden's unpopularity since 2020, with polls suggesting they now represent 16% to 20% of the electorate, Axios' Zachary Basu writes.

  • That makes 2024 more similar to 2016 — when exit polls showed 18% of voters disliked both Trump and Hillary Clinton — than 2020, when Biden and Trump's dual unfavorables amounted to just 3% of the vote.

The key buckets:

1. 🐘 Old-guard Republicans: The GOP establishment may be a shell of its former self, but the ranks of the excommunicated have grown considerably since the early days of the "Never Trump" movement.

  • The list of disillusioned Trump allies is longer than ever, with former GOP primary rivals Nikki Haley and Chris Christie among the most prominent double haters.

2. 🪧 Pro-Palestinians: Arab-Americans and left-wing activists have accused Biden of enabling "genocide" with his support for Israel's war in Gaza, generating heartburn for Democrats ahead of their August convention in Chicago.

  • Progressive activists are increasingly rejecting the "lesser of two evils" paradigm that historically has benefited Democrats, raising the risk that they'll boycott the election or vote third party.

3. 🦾 Techno-optimists: This loose network of "free speech" advocates and DEI critics isn't significant in raw numbers — but could be when it comes to money and influence. It's also shifting unmistakably toward Trump.

  • Elon Musk, who says he voted for Biden in 2020, has become one of the president's loudest critics. Venture capitalists David Sacks, who said Trump "disqualified himself" after Jan. 6, and Chamath Palihapitiya, a former Democrat, are planning a Trump fundraiser in San Francisco, Puck reports.

👀 What we're watching: RFK Jr. could win as much as 38% of the double hater vote, according to a Monmouth poll out this week.

  • Polls vary on whether Kennedy will siphon more support from Biden or Trump. Both campaigns are taking the spoiler threat extremely seriously.

A ritzy donor event with former President Trump in Palm Beach today will double as an audition for several contenders to be his VP, Axios' Alex Thompson reports.

  • Why it matters: The months-long shadow campaign to become Trump's running mate in the race for the White House is moving into the light.

Trump will host hundreds of donors and prominent GOP lawmakers at Mar-a-Lago in the first large, in-person gathering of several potential VP picks.

  • Contenders include Sens. Marco Rubio of Florida, J.D. Vance of Ohio and Tim Scott of South Carolina, Reps. Elise Stefanik of New York and Byron Donalds of Florida, and Govs. Doug Burgum of North Dakota and Kristi Noem of South Dakota.

This week, Trump told Milwaukee's Fox 6 that he probably won't announce his pick "too much before the [GOP] convention," which runs July 15-18 in Milwaukee.

Behind the Curtain: 6% of six states

The titanic Biden-Trump election likely will be decided by roughly 6% of voters in just six states, top strategists in both parties tell us, Mike Allen and Jim VandeHei write.

  • Each side will spend billions to reach those voters over the next six months.

Why it matters: Roughly 244 million Americans will be eligible to vote. But 99.5% of us won't be deciders: We won't vote. Or we always vote the same way. Or we live in states virtually certain to be red or blue.

🔬 Zoom in: Both campaigns are obsessed with six states — Arizona, Georgia, Michigan, Nevada, Pennsylvania and Wisconsin.

  • Those were the battlegrounds disputed by Donald Trump after the 2020 election. And they're the '24 toss-ups, as rated by The Cook Political Report with Amy Walter.
  • A seventh state, North Carolina, is included in some swing-state polls. It's rated "Lean R" by Cook. The other 43 states are either "solid" or "likely" for one of the parties.

🥊 Reality check: In our private conversations, Democrats are a lot more worried about November than Republicans are. Democrats say the race is winnable. Republicans think they're winning. The swing-state map is a big reason why.

  • An April poll of swing states by Bloomberg and Morning Consult found President Biden two points ahead in Michigan, with Trump ahead or statistically tied in every other swing state.

🔎 Between the lines: The Trump campaign is talking to that 6% of persuadable voters when it hammers immigration, crime and inflation.

  • Biden is aiming at the 6% when he emphasizes abortion, democracy and stability — and says in response to Trump's vows for a second term: "Do you want to go back to any of that? I don't think so."

🧮 By the numbers: Biden's winning margin in the six swing states in 2020 totaled just over 300,000 votes out of 158 million cast for president nationwide.

  • The Washington Post found that the winner would have changed by flipping just over 81,000 votes in four states (Arizona, Nevada, Wisconsin and Georgia).

🖼️ The big picture: Doug Sosnik, a senior adviser to President Clinton and widely followed election oracle, tells us the map is so narrow largely because states are tightly clustered by educational level, turning them predictably red or blue.

  • "Education now transcends race as the best predictor of voting," he told us. "People are increasingly choosing to live around others who share their values and beliefs, which has led to a homogenization of how communities vote."

👀 What we're watching: At the RNC's spring meeting in Palm Beach, Fla., over the weekend, Trump's campaign showed donors a deck arguing that Minnesota and Virginia — both of which Biden won handily in 2020 — belong on the list of states in play.

  • A top Democratic strategist dismissed that as spin. "MN is to them what FL is to us," the strategist texted. "Attractive but unwinnable.

Former President Trump is scheduled to spend part of his day off from court today at a Mar-a-Lago dinner with supporters who spent thousands of dollars for Trump "Mugshot Edition" NFTs (non-fungible tokens), Axios' Sophia Cai has learned.

  • Why it matters: Trump frequently complains that his criminal trial is keeping him from campaigning in swing states. But he also prioritizes using his name and likeness to make money.

Trump's trial is in recess on Wednesdays. Last Wednesday, he campaigned in Wisconsin and Michigan. The Wednesday before, he played golf.

  • "I'd like to be campaigning," Trump told reporters yesterday outside the courtroom.

Trump, who flew home to Palm Beach yesterday, is expected to join supporters who bought at least 47 Trump NFTs (at $99 each) this evening, according to a copy of the dinner invitation.

  • Supporters who bought enough NFTs to get invited to the dinner are supposed to receive a physical card with a piece of the suit Trump is said to have worn the day he was arrested in Georgia last August.
  • Buyers who spent nearly $10,000 were invited to a VIP cocktail reception before the dinner. They'll receive physical cards with pieces of the suit and tie that Trump was wearing when he was arrested.

RFK Jr. claimed brain worm

In 2012, Robert F. Kennedy Jr. said in a divorce deposition that a doctor suggested he may have had a dead parasite in his brain, the New York Times reports.

  • The doctor believed the spot "was caused by a worm that got into my brain and ate a portion of it and then died," Kennedy said.
  • "The issue was resolved more than 10 years ago, and he is in robust physical and mental health," the campaign said.

Shrewd legal maneuvering — along with some luck and prosecutors' self-inflicted errors — have made November's election as much about former President Trump's freedom as it is about the country's direction:

  • If he's a private citizen, he faces years of expensive trials and could spend the rest of his life in prison if found guilty.
  • If he wins, the three felony cases that haven't gone to trial could be pushed off indefinitely.

Why it matters: Even if Trump is convicted in the Manhattan hush-money case, voters may be the only jury that matters, Axios' Erin Doherty and Alex Thompson write.

Trump's team seems to have succeeded in pushing his most serious trials until after the election. So the race is also a referendum on Trump's freedom.

  • "It really is an all-or-nothing strategy," said Robert Mintz, a former federal prosecutor. "The delaying tactic could be a complete victory if he were to be elected president."

Nikki Haley is under active consideration by Donald Trump's campaign to be his running mate, Axios' Alex Thompson reports.

  • Why it matters: The bitter primary rivals' relationship remains chilly. But Trump, 77, could pick Haley, 52, if he were convinced she'd help him raise money and win the presidency — which could keep him out of prison.

Republicans close to both politicians believe it's in Haley and Trump's mutual interests to reconcile, despite their furious fight in the GOP primaries, and their differences on some big issues.

  • Trump is scrambling to make up a fundraising disadvantage against President Biden and pay legal fees. Haley has deep ties to donors who are wary of the former president.
  • A reconciliation with Haley — his former UN ambassador, and former South Carolina governor — could help Trump attract college-educated Republicans who have kept voting for her in primaries even after she dropped out.
  • In Indiana's primary this week, Haley got more than 20% of the vote, in a contest that allowed Democrats and independents to cast ballots in the GOP race.

There also could be advantages for Haley:

  • She hasn't endorsed Trump. If she continues to withhold her support and Trump loses in November, the GOP's conservative base could blame her.
  • That likely would threaten any future presidential campaign or future in GOP politics for her.

🥊 Reality check: Earlier this year, Trump said Haley didn't have "presidential timber." Haley said Trump was "not qualified" to be president.

  • They have different views on issues — including aid to Ukraine, and changing Social Security and Medicare.
  • Some people close to Trump are strongly opposed to Haley, given her hawkish record on foreign policy.

🔎 The intrigue: Biden's campaign has run ads trying to appeal to Haley voters who are wary of Trump.

  • "If you voted for Nikki Haley, Donald Trump doesn't want your vote," the ad reads between clips of Trump attacking Haley.

🔮 What's next: Haley is gathering about 100 of her biggest donors in Charleston, S.C., Monday and Tuesday to thank them for supporting her presidential campaign, The Wall Street Journal reported.

Spokespeople for Trump and Haley declined to comment.

President Biden is moving to defang Donald Trump on a trio of issues central to his political identity: toughness on the border, aggressiveness with China and closeness with CEOs.

  • Why it matters: Biden is vulnerable in all three areas. His plans to trump Trump, expected in coming weeks, show the hawkish direction Trump has moved the politics of China and immigration, Axios' Hans Nichols and Alex Thompson report.

Both Biden and Trump now support aggressive tariffs on Chinese goods.

  • Both are threatening to dramatically curtail access to asylum at the southwest border.
  • A decade ago, those positions were pushed only by GOP fringes.

On China, Biden is preparing to extend and increase Trump's tariffs on some $300 billion in Chinese goods, with an announcement expected Tuesday.

  • The president wants to triple tariffs on Chinese steel and aluminum. He also aims to dramatically raise tariffs on clean-energy goods — quadrupling those fees on Chinese electric vehicles, The Wall Street Journal reported Friday.

On the border, Biden is preparing an executive order to try to stem illegal border crossings. He'll rely on the same section of the Federal Code, known as 212(f), that Trump used to slow immigration and impose a so-called Muslim ban.

  • Biden also is needling Trump on the ex-president's core brand as a business-friendly entrepreneur. Biden has launched his own strategy for courting CEOs, encouraging them to make big job-producing investments.

🔎 Between the lines: Trump is moving further right.

  • He has called for a new minimum of 60% tariffs on Chinese goods, a move Biden rejected and called inflationary.
  • On immigration, Trump has said undocumented immigrants are "poisoning the blood of our country," a comment Biden frequently condemns.
