He has the right to declare YOU an enemy combatant. 948a “(7) UNLAWFUL ENEMY COMBATANT.—The term ‘unlawful enemy combatant’ means an individual determined by or under the authority of the President or the Secretary of Defense. Again Jose Padilla was declared such and therefore stripped of his rights as a US citizen. Just because the impression is given that it does not apply to US citizens it does not mean that it doesn't apply. It clearly can apply. It was designed specifically to be that way! Jose Padilla was arrested and held before the Military Commissions Act was passed. Some are making the case that his Constitution right to a quick trial was violated and I would tend to agree.
