In addition, a common law marriage is simply that--a marriage that has been declared to be formalized by a judge. Without that declaration of a judge a common law marriage does not exist. NOTE: In no case does simply living together, which may be one, but not the only requirement, result in a common law marriage. Common law marriage requires more than simply living together.
