I consider this case to be both interesting and novel--that is not a positive statement. Do you think that the person should not be deported? That is one issue that is valid and needs discussion, litigation or whatever. Or, do you support the family in litigating on the basis that their religious rights have been violated? If this is your position, you are on very weak legal ground. I am supporting the family because their religious right is being violated but I am also saying that the fact is the husband was an illegal immigrant and if the law says he must be deported then I think the husband broke the law first even before his religious beliefs are being violated. They will likely lose on this point. There are other points of law on which they may have the potential to win. I, personally hope that they do win.
