I will propose a situation.  Tell me what you think will be the answer to the questions that I ask.

There is a claimed religious group known as the Church of the Flying Spaghetti Factory (CFSF).  Members of the CFSF call themselves Pastafarians.  They sometimes wear colanders on their heads.

Richard S. Moser claims to be a Pastafarian.  He wishes to be photographed with a colander on his head for his drivers license.

1)  Should Mr. Moser be allowed to be photographed wearing a colander on his head and why?

 2)  Should the CFSF be considered a valid religion and why?

not unless he consistently wears his metallic snood to work, to school, to go shopping, or to do any and all other public activities... (and even if he did, CFSF isn't seen as a valid religion in the US)

no.  It's a behavioral satire against religion.
