Trump slams GOP's abortion messaging

In an hourlong interview with new "Meet the Press" moderator Kristen Welker, Trump criticized Republicans for pushing abortion bans without exceptions and vowed to bring "both sides" together on one of the country's most polarizing issues.

Why it matters: Trump remains the prohibitive favorite to win the GOP nomination, but his comments on abortion — including his labeling of Florida Gov. Ron DeSantis' six-week ban as "terrible" — are likely to infuriate conservative activists.

  • Trump refused to commit to signing a federal abortion ban but mused that a 15-week ban "seems to be a number that people are talking about right now."
  • "I would sit down with both sides and I'd negotiate something, and we'll end up with peace on that issue for the first time in 52 years," he told Welker.

Other highlights:

  • On the 2020 election: Trump said he did not listen to lawyers and advisers who told him there was no evidence of widespread fraud "because I didn't respect them." He added that he does not believe the U.S. has "much of a democracy right now," citing his indictments and negative media coverage.
  • On impeachment: Trump denied speaking to House Speaker McCarthy about the decision to open an impeachment inquiry into Biden, saying his Republican allies in Congress are "more proactive than I am."
  • On Ukraine: Trump expressed appreciation for recent compliments from Russian President Vladimir Putin and vowed to negotiate a "fair deal for everybody" to bring the war to an end. He did not elaborate on whether that meant allowing Russia to keep Ukrainian territory it has illegally seized.

📺 Spot of the week: Beshear's abortion attack

Democrats are hitting Republicans over abortion policy even in the reddest of states — as illustrated by this new attack ad from Kentucky Gov. Andy Beshear against Republican rival Daniel Cameron.

  • "This is to you, Daniel Cameron. To tell a 12-year-old girl she must have the baby of her stepfather who raped her is unthinkable," a girl named Hadley says to the camera. The ad began airing Wednesday across broadcast TV in Kentucky.
  • Beshear is running for re-election against Cameron, the state's attorney general. Polls show Beshear narrowly ahead in the red-state contest — the highest-profile election taking place this November.

Zoom out: Kentucky's abortion law is among the strictest in the country, only allowing an exception if the mother's life is at risk.

What they're saying: After the ad aired, Cameron put out a videotaped statement accusing Beshear of running "the most despicable campaign in Kentucky history."

The bottom line: The fact that Republicans are running away from hardline positions on abortion in a deeply conservative state like Kentucky is a sign of how politically problematic the issue has become for the GOP.

  • This is the second ad the Beshear campaign has aired attacking Cameron on abortion in the general election campaign.
  • In red states like Kentucky, it's usually Democrats who are on the defensive. The tables have turned dramatically since Roe v. Wade was overturned, which allowed right-wing GOP lawmakers to set abortion policy in conservative states.

"Pro-life" and "pro-choice" — decades-old labels around abortion in the U.S. — are rapidly losing favor among lawmakers and advocates, Axios' Natalie Daher reports.

  • Why it matters: Abortion rights are expected to be a major issue 2024, and helped Democrats avoid sizable losses in last year's midterms.

What's happening: Many activists and politicians say "pro-life" and "pro-choice" aren't nuanced enough to describe policy positions after the Supreme Court overturned Roe v. Wade last year.

  • Abortion rights supporters have instead embraced "freedom" over "choice."
  • Abortion rights opponents are emphasizing "young families and mothers," adoption and "baby."

What's happening: Advocates say a hard-to-track and constantly changing patchwork of state restrictions and bans means the old labels no longer apply. The spectrum now includes varied views on weeks of pregnancy and exceptions in the cases of rape, incest and the health of the pregnant person.

  • NARAL Pro-Choice America, one of the country's most influential abortion-rights groups, rebranded last month to Reproductive Freedom for All.
  • The organization's president, Mini Timmaraju, told Elle the frame of choice versus life was "a failing binary."

After a midterm red wave that never materialized, Republicans are looking to shift from "pro-life" to recapture suburban women.

  • In a private meeting last month, Republican strategists from One Nation warned GOP senators that the old terms are becoming muddled, The Wall Street Journal reported.

Research from the group, which is aligned with Senate Minority Leader Mitch McConnell, found that the Supreme Court decision "shifted more people (including some Republicans) into the anti-Dobbs 'pro-choice' camp."

  • A polling memo last month for One Nation by Axis Research, concluded:
"[T]he most universally persuasive messaging on abortion includes an acknowledgment that this debate is about more than just abortion. Acknowledging that this is also about needing a better safety net to support young families and mothers, like better access, an easier adoption process and more affordable childcare, is a very strong message."

Last night's election results solidified a consensus that has been gaining steam for 17 months:

Why it matters: President Biden's polling weakness ultimately may not matter if Republicans can't find a way to effectively message or — at the very least — sideline abortion as a national issue and driver of turnout.

  • Virginia Gov. Glenn Youngkin's (R) bet that a "reasonable" ban on abortions after 15 weeks of pregnancy — a strategy backed by major anti-abortion rights groups — was soundly rejected, as Democrats flipped the state House and kept control of the state Senate.
  • In solid-red Ohio, 56.6% of voters supported enshrining abortion rights in the state constitution — meaning abortion access has gone a stunning 7 for 7 in state ballot initiatives since Roe ended.

What they're saying: Sen. J.D. Vance (R-Ohio) called the results a "gut punch," outlining five reasons — ranging from campaign finance failures to voter mistrust — that the anti-abortion side was defeated.

  • "[W]e've spent so much time winning a legal argument on abortion that we've fallen behind on the moral argument," Vance said.
  • SBA Pro-Life America, one of the nation's top anti-abortion rights groups, warned in a memo today that Democrats are massively outspending Republicans and that abortion "will be an issue in every race in 2024."

That position is being universally echoed by Democrats too:

  • "Abortion is the No. 1 issue in the 2024 campaign," Illinois Gov. J.B. Pritzker, a top Biden surrogate, told the New York Times. "If you're not talking about protecting women's reproductive rights as a Democrat, you're not doing it right."

Between the lines: Anti-abortion politics are deeply ingrained in the Republican Party's power centers, making it exceedingly difficult to change voters' perceptions in time for the 2024 election.

  • Former President Trump has tried to distance himself from strict abortion bans — even as he has repeatedly boasted that he's responsible for the end of Roe through his appointments of conservative Supreme Court justices.
  • Florida Gov. Ron DeSantis, one of Trump's chief rivals, signed a six-week abortion ban this year and said he would favor a 15-week federal ban.
  • New House Speaker Mike Johnson (R-La.) is a staunch abortion-rights opponent who also voted against a bill last year to codify access to contraception.

What to watch: Ohio's abortion rights victory has incentivized advocates to ramp up efforts to get abortion on the ballot in key 2024 states such as Arizona, Nevada and Florida, Axios' Stef Kight reports.

The other side: "Advocates of same-sex marriage suffered a string of 32 losses at the ballot box before succeeding for the first time, in the bluest of states, in 2012," the editors of the National Review wrote today in defense of the anti-abortion losing streak.

  • "We disagreed with their objective, and both sides are more entrenched on the abortion issue, but their success serves as a reminder that a string of defeats at the ballot box is no reason to believe a cause is lost."

Scoop: Dems' new abortion plan

Democrats are rushing to get abortion-related initiatives on the ballot next year in key swing states, Axios' Stef Kight and Alex Thompson report.

  • They're hoping they can replicate this week's success in Ohio to boost President Biden and down-ballot Democrats in 2024.

🔎 Why it matters: Even in the face of bleak polling on the economy, abortion continues to be a winning issue for Democrats — even, apparently, in red states.

  • "Ohio really has taken this ballot measure strategy to protect abortion rights to the next level," said Kelly Hall, executive director of The Fairness Project, a progressive nonprofit.

🗳️ What we're watching: Advocates are particularly focused on potential ballot initiatives in Arizona, Nevada and Florida, as well as Republican-dominated Nebraska and South Dakota.

  • Florida may be an uphill climb — it has one of the most difficult ballot-initiative processes in the country. And some national advocates believe on-the-ground organizing there got started too late.
  • But organizers still feel the wind at their backs. Voters have explicitly endorsed abortion rights via ballot initiatives in seven states since the Supreme Court overturned Roe v. Wade last year — California, Kansas, Kentucky, Michigan, Montana, Vermont and now Ohio.

Behind the scenes: In private and with a group of abortion-rights organizers in Miami last month, second gentleman Doug Emhoff described Democrats' path to victory in 2024 as "Dobbs and Democracy," according to two people familiar with his comments.

Anti-abortion leaders woke up Wednesday to the sobering reality that abortion rights remain the nation’s predominant political issue. Decisive wins in swing and red states in two national election cycles since Roe v. Wade was overturned last year have given momentum to reproductive rights groups, who aggressively campaigned and fundraised in key states across the country, and intend to triple down for 2024.

Democrats' rush to get abortion-related initiatives on the ballot in key states could throw a wrench in Republicans' effort to keep the House in 2024, Axios' Andrew Solender reports.

Why it matters: Election results in Ohio, Kentucky and Virginia last Tuesday demonstrated the issue is still boosting Democrats at the ballot box more than a year after Roe v. Wade was overturned.

State of play: As many as eight states could have an abortion-related referendum on the ballot next November. Among those states are nearly two dozen House districts rated as some degree of competitive by Cook Political Report.

  • Maryland and New York — which alone could have half a dozen swing districts, pending a redistricting lawsuit — are both set to have referenda on the ballot.
  • Abortion rights advocates are in the process of trying to get constitutional amendments preserving access to abortion on the ballot in Arizona, Florida and Nevada.
  • In Iowa, the GOP-controlled legislature could set the stage for a vote on an amendment clarifying the state constitution doesn't protect abortion. In Colorado and Nebraska, there are pushes for both pro- and anti-abortion rights ballot measures.

What to watch: New York Democrats plan to spend at least $20 million in support of a 2024 ballot measure codifying abortion protections, racial and LGBTQ+ equality, disability rights and more.

  • "I think what we saw [in Tuesday's elections] validates that ... when you try to take freedoms away, people reject it," Rep. Pat Ryan, the only Democrat in a New York swing district, told Axios.
  • The state will be a hotbed of competitive 2024 House races: five Republican freshmen hold seats there that President Biden won in 2020.

The other side: Several Republican lawmakers in states with possible abortion-related ballot measures stressed the key to defusing the issue's potency is striking a balance.

  • "I've done significant polling on this. Most people in our district fall into the 12-15 week [abortion restriction] bell curve," Rep. Don Bacon (R-Neb.) told Axios. "I've had a lot of people say, 'Don, I'm pro-choice, but 12 weeks is where it should be.'"
  • "There will be New Yorkers who turn out for that reason," Rep. Marc Molinaro (R-N.Y.) said of his state's ballot initiative. "I'm going to continue to navigate it as I have for the last 30 years."

Zoom out: Several of these states are also among the most hotly contested Senate battlegrounds next year.

  • Democrats are trying to keep control of Nevada and Arizona — both states that went for Biden by just a few percentage points in 2020.
  • Democrats are also looking to Sen. Rick Scott (R-Fla.) as a top target to offset their likely loss in West Virginia following the retirement of Sen. Joe Manchin (D-W.Va.).

How Trump could stop most abortions

The next Republican president could effectively ban most abortions through a simple policy change at the Justice Department, experts and advocates on both sides of the abortion debate tell Axios' Caitlin Owens.

  • Why it matters: Republicans disagree about whether to pursue a national abortion ban, which would face long odds in Congress. But a GOP president may be able to unilaterally curb access to medication abortion across the country using an obscure 19th-century law.

At issue is the meaning of the 1873 Comstock Act, which banned the mailing of "obscene" material like pornography, as well as abortion drugs and contraception. While the law has been cut down over the years, the abortion provision remained — but was ignored while Roe v. Wade was in place.

  • Medication abortion — which usually involves the use of two drugs, mifepristone and misoprostol, in the first 10 weeks of pregnancy — accounts for more than half of abortions in the U.S.

The Heritage Foundation, which has proposed detailed policies for a potential GOP administration, argues that Comstock "unambiguously prohibits mailing abortion drugs" and says the next administration should "enforce federal law against providers and distributors of [abortion] pills."

  • The Biden administration disagrees with this interpretation. A Justice Department memo issued last year contends that the law doesn't prohibit mailing abortion drugs when the sender expects them to be used lawfully.
  • A new president could easily change that interpretation, experts say: The administration could not just restrict patients from receiving pills at home, but also stop pharmacies and health care providers from getting shipments.

"If Trump were elected," said Lawrence Gostin, a Georgetown Law professor who supports abortion rights, "not only would I not be surprised, but I would expect the administration to direct DOJ to overturn its guidance on the Comstock Act, and rule that shipping mifepristone through the U.S. Postal Service is a violation of that statute."

  • The Trump campaign didn't respond to a request for comment on its thinking about the Comstock Act.

The other side: Abortion rights advocates argue that interpreting Comstock so literally is ignoring its context and legal precedent.

  • They would almost certainly sue to block a DOJ policy change.
  • "It's tailor-made for a Supreme Court that considers itself textualist," said Mary Ziegler, a UC Davis law professor and legal historian.
