President Biden has two positions on abortion:

  • He's personally uncomfortable with it, but publicly adamant that a woman has a right to choose, Axios' Hans Nichols reports.

Why it matters: Biden's ambivalent stance allows him to signal to voters that he accepts — but doesn't celebrate — abortion. It's a position that puts Biden in the center of the gray zone of American public opinion on abortion.

State of play: Years of polling indicate that Americans are in the middle on abortion, with 62% saying it should be legal in most or all cases, according to a comprehensive 2023 Pew survey.

  • "I believe Roe v. Wade was right," Biden said at the White House today. "I am not supporting — they are not supporting — abortion on demand."
  • "A majority of Americans agree," he added.

Driving the news: The Biden campaign and the White House are using the 51st anniversary of the Roe v. Wade decision to try to harness the outrage many Democrats — as well as swing voters — share about the Supreme Court's decision to overturn it in 2022.

  • The clear goal is to link former Trump with the fall of Roe.
  • "The former president handpicked three Supreme Court justices because he intended for them to overturn Roe," Vice President Kamala Harris said in remarks in Wisconsin today.
  • Tomorrow, Biden and Harris will appear at a rare joint rally in Virginia with their spouses by their sides — the first time all four have appeared together at a campaign rally since Biden announced his re-election bid.

Why abortion won't be on the Texas ballot

A series of wins for abortion rights supporters has energized Democrats around the country — but abortion access itself won't be on the Texas ballot in November.

The big picture: Democrats have notched abortion rights-related victories in red or swing states like Kansas, Michigan, Kentucky and Ohio.

Yes, but: Texas remains a deeply red state.

  • Democratic activists and politicians see abortion as a winning issue, but they won't be able to put the potentially galvanizing referendum on the November ballot.

State of play: Amendments to the Texas Constitution can be put before voters only after being approved by two-thirds of the Texas House and Senate

  • The Republican-controlled Legislature was not about to vote to put such a question before voters.

What they're saying: "Polling suggests that abortion remains an issue that should be advantageous to Democrats, but which they lack the political leverage to exploit directly," Jim Henson and Joshua Blank observed last month in their Texas Politics Project blog.

Reality check: "Trust women and their doctors" was a key talking point in 2022 for Texas Democrats — when Beto O'Rourke, lost by nearly 11 points to Gov. Greg Abbott.

The bottom line: "While pro-choice Democrats have pointed to states in which voters have turned out to support abortion rights as evidence of the issue's purchase in the electorate, the opportunity for such a move in Texas is functionally nonexistent," Blank and Henson conclude.

Republicans are trapped in a political minefield over reproductive rights — paralyzed in fear that their vulnerabilities on abortion and in-vitro fertilization (IVF) could hand Democrats the 2024 election, Axios' Zachary Basu writes.

  • Why it matters: Rarely has a political issue proven so salient, so personal and so animating for voters at both the state and national level. The Alabama Supreme Court's ruling on IVF suggests the fallout from the end of Roe v. Wade is far from contained.

Keenly aware of their renewed political jeopardy, Republicans — including former President Trump — have scrambled to declare their approval of IVF, which Americans overwhelmingly support.

  • The Alabama Supreme Court's ruling declared that frozen embryos are children, prompting some clinics to pause treatment in fear they could be prosecuted for discarding embryos — a common occurrence in IVF.
  • The intense backlash led the Alabama legislature to pass legislation Thursday to protect patients and doctors involved with IVF if embryos are damaged or destroyed.

But at a broader level, few Republicans have opined on whether discarding leftover embryos is illegal or immoral — or whether there should be federal protections for IVF.

  • One explanation for the silence: 125 House Republicans, including Speaker Mike Johnson (R-La.), co-sponsored a bill last year declaring that life begins at "the moment of fertilization."
  • Eager to paint Republicans' support for IVF as disingenuous, Senate Democrats attempted to pass a bill Wednesday enshrining federal protections for fertility treatments — knowing it would be blocked.

🖼️ The big picture: The GOP has yet to find a coherent strategy for countering the IVF crisis on the campaign trial.

  • The stunning streak of Democratic victories since the Supreme Court overturned Roe in June 2022 suggests the same goes for abortion rights.

Unlikely face of abortion rights

Kate and Justin Cox would have welcomed a baby girl — their third child — this spring if their pregnancy went smoothly.

  • Instead, the Dallas-area couple became a "reluctant face" of the abortion rights movement, a new Time story says.

Why it matters: Their case against Texas in December was the first time since Roe v. Wade was overturned that a pregnant woman asked a court for permission to get an abortion under a health exemption, Center for Reproductive Rights president Nancy Northup told Time.

Flashback: The Coxes weren't paying attention to abortion politics before their third pregnancy. They assumed Texas' ban had exceptions.

Threat level: Kate Cox was 18 weeks pregnant when she learned that the baby may have Trisomy 18, which has a high risk of a congenital heart defect and death.

  • More defects were found, which meant the baby was likely to die in utero or shortly after birth.

Yes, but: Cox was told she wouldn't be able to get an abortion in Texas. The Center for Reproductive Rights filed a lawsuit on her behalf to get answers from the legal system.

  • Cox was 20 weeks pregnant when a judge gave her permission to terminate the pregnancy. Texas Attorney General Ken Paxton asked the state Supreme Court to halt the lower court's order.
  • The Coxes decided to get an abortion in New Mexico instead of waiting longer for a final decision.
  • The Supreme Court later ruled that Cox didn't qualify for an abortion under the law's medical exception.

The other side: "Texas will proudly continue as a nationwide leader in the protection of the unborn, and the OAG will be steadfast in its mission of defending our state's pro-life laws," Paxton's office said last year.

What's next: The Texas Medical Board has proposed more guidance on abortions, though some critics have said it doesn't give enough clarity.

Florida’s high-court abortion ruling just added to GOP heartburn

On April 1, the Florida Supreme Court — in a 4-3 vote — cleared the way for the public to decide an abortion-rights ballot that would amend the Florida Constitution to protect access to abortions in November. But in a 6-1 separate ruling, justices allowed for a 6-week abortion ban across Florida starting May 1. That timetable further endangers women of childbearing age in disastrous ways.

GOP's quiet embrace

Former President Trump's decision to not back a federal abortion ban has ended for now any serious GOP talk about such legislation, Axios' Stef Kight and Stephen Neukam report.

Why it matters: Trump's position reflects the reality that the GOP is no longer close to the votes needed to pass a bill through the Senate on their most risky political issue.

  • Just four years ago — before the Supreme Court tossed out Roe vs. Wade — 51 Republicans signed on to a 20-week federal ban, as Politico noted.
  • In 2022 — shortly after the end of Roe — 10 Republicans signed on to a 15-week federal ban from Sen. Lindsey Graham (R-S.C.).

Zoom in: Multiple Republican sources told Axios that Trump's move was "smart" and reflects where they believe most of America is in the post-Roe era.

  • Even Republicans who may quietly support abortion restrictions recognize the political landmine the issue is and have been hesitant to support any such efforts.

Right on cue, the Biden campaign released an ad today featuring a Texas woman who said she almost died because she was not able to get an abortion after a miscarriage, Axios' Erin Doherty reports.

  • "Because Donald Trump killed Roe v. Wade, Amanda was denied standard medical care to prevent infection, an abortion," the ad reads.

Zoom in: GOP Senate candidates in some of the toughest races this year rushed to agree with Trump's position.

  • "I am pro-life and believe the issue is now correctly left at the state level," Nevada Republican Sam Brown said in a statement.
  • Arizona Republican Kari Lake said on X that she does not support a federal abortion ban and that "policy should be up to individual states."
  • Ohio Republican Bernie Moreno "has always said it should be primarily decided at the state level," a spokesperson told Axios.

Between the lines: "Republicans do not support a federal ban on abortion," Sen. Steve Daines (R-Mont.), who chairs the National Republican Senatorial Committee, told Axios.

  • "[T]hat's a lie you're hearing from the Democrats to scare voters."
  • Daines was one of two original co-sponsors on Graham's 15-week federal abortion ban bill.

The bottom line: Neither of the two GOP senators currently running to replace Mitch McConnell as GOP leader came out against Trump's stance.

  • Sen. John Thune (R-S.D.) told reporters that Trump's view likely reflected the current consensus among the majority of Republicans — but "that could change over time." Thune supported the 15-week ban in 2022.
  • Sen. John Cornyn (R-Texas) said it was a "practical matter" to leave abortion standards to the states because there weren't 60 votes in the Senate. He did not answer when asked what he would do if he became majority leader.
