Instead, the Dallas-area couple became a "reluctant face" of the abortion rights movement, a new Time story says. Why it matters: Their case against Texas in December was the first time since Roe v. Wade was overturned that a pregnant woman asked a court for permission to get an abortion under a health exemption, Center for Reproductive Rights president Nancy Northup told Time. Flashback: The Coxes weren't paying attention to abortion politics before their third pregnancy. They assumed Texas' ban had exceptions. Threat level: Kate Cox was 18 weeks pregnant when she learned that the baby may have Trisomy 18, which has a high risk of a congenital heart defect and death. More defects were found, which meant the baby was likely to die in utero or shortly after birth. Yes, but: Cox was told she wouldn't be able to get an abortion in Texas. The Center for Reproductive Rights filed a lawsuit on her behalf to get answers from the legal system. Cox was 20 weeks pregnant when a judge gave her permission to terminate the pregnancy. Texas Attorney General Ken Paxton asked the state Supreme Court to halt the lower court's order. The Coxes decided to get an abortion in New Mexico instead of waiting longer for a final decision. The Supreme Court later ruled that Cox didn't qualify for an abortion under the law's medical exception. The other side: "Texas will proudly continue as a nationwide leader in the protection of the unborn, and the OAG will be steadfast in its mission of defending our state's pro-life laws," Paxton's office said last year. What's next: The Texas Medical Board has proposed more guidance on abortions, though some critics have said it doesn't give enough clarity. Why it matters: Trump's position reflects the reality that the GOP is no longer close to the votes needed to pass a bill through the Senate on their most risky political issue. Just four years ago — before the Supreme Court tossed out Roe vs. Wade — 51 Republicans signed on to a 20-week federal ban, as Politico noted. In 2022 — shortly after the end of Roe — 10 Republicans signed on to a 15-week federal ban from Sen. Lindsey Graham (R-S.C.). Zoom in: Multiple Republican sources told Axios that Trump's move was "smart" and reflects where they believe most of America is in the post-Roe era. Even Republicans who may quietly support abortion restrictions recognize the political landmine the issue is and have been hesitant to support any such efforts. Right on cue, the Biden campaign released an ad today featuring a Texas woman who said she almost died because she was not able to get an abortion after a miscarriage, Axios' Erin Doherty reports. "Because Donald Trump killed Roe v. Wade, Amanda was denied standard medical care to prevent infection, an abortion," the ad reads. Zoom in: GOP Senate candidates in some of the toughest races this year rushed to agree with Trump's position. "I am pro-life and believe the issue is now correctly left at the state level," Nevada Republican Sam Brown said in a statement. Arizona Republican Kari Lake said on X that she does not support a federal abortion ban and that "policy should be up to individual states." Ohio Republican Bernie Moreno "has always said it should be primarily decided at the state level," a spokesperson told Axios. Between the lines: "Republicans do not support a federal ban on abortion," Sen. Steve Daines (R-Mont.), who chairs the National Republican Senatorial Committee, told Axios. "[T]hat's a lie you're hearing from the Democrats to scare voters." Daines was one of two original co-sponsors on Graham's 15-week federal abortion ban bill. The bottom line: Neither of the two GOP senators currently running to replace Mitch McConnell as GOP leader came out against Trump's stance. Sen. John Thune (R-S.D.) told reporters that Trump's view likely reflected the current consensus among the majority of Republicans — but "that could change over time." Thune supported the 15-week ban in 2022. Sen. John Cornyn (R-Texas) said it was a "practical matter" to leave abortion standards to the states because there weren't 60 votes in the Senate.
