Moderators Gregory Matthews Posted June 25, 2022 Moderators Share Posted June 25, 2022 On May 26, 2022, a class action lawsuit, representing thousands of employees, was filed against Adventist Health System West and its associated companies, in the United States District Court for Eastern District of California. The complaint alleges that when Adventist Health System West laid of thousands of employees if failed to comply with the provisions of the Consolidated Omnibus Budget Reconciliation act (COBRA) and California law which provided enhanced rights, to continued health-care coverage. The complaint alleges that Adventist Health falsely claimed to be exempt from such provision of the law due to it being a church plan. The complaint alleges that in truth Adventist Health and its associated companies is a five (5) billion dollar company that is not a church, and therefore is subject to the provisions of COBRA and to California law.
