Trump's big fear

Trump's new legal defense fund for aides and employees may double as both an act of benevolence and a potential insurance policy against a practice he has long loathed: flipping.

Why it matters: New federal charges against Trump — who once said cooperating with prosecutors in exchange for leniency "ought to be illegal" — rely in large part on the testimony of a Mar-a-Lago employee who allegedly was asked to delete surveillance footage subpoenaed by investigators.

Driving the news: The superseding indictment unveiled Thursday in Trump's classified documents case ensnared a new defendant — Mar-a-Lago property manager Carlos De Oliveira — in addition to longtime Trump valet Walt Nauta.

  • The indictment alleges that in June 2022, De Oliveira pulled aside another Mar-a-Lago employee — identified in media reports as IT staffer Yuscil Taveras — and asked for their conversation to remain private.
  • In a scene the indictment describes in remarkable detail, De Oliveira allegedly told Taveras that "the boss" wanted the server housing surveillance footage to be deleted — a request Taveras allegedly said he could not help with.

The intrigue: Taveras received a target letter after Trump and Nauta were indicted last month — prompting him to meet with investigators and provide new information about De Oliveira and the alleged cover-up, CNN reports.

Between the lines: Taveras may have cooperated, but there's no indication that Trump's co-defendants — whose legal expenses have so far been covered by Trump's Save America PAC — intend to flip.

  • Two weeks after the FBI searched Mar-a-Lago last August, the indictment alleges Nauta called another unidentified Trump employee and said words to the effect of "someone just wants to make sure Carlos is good."
  • The Trump employee allegedly told Nauta that De Oliveira was loyal and would not do anything to affect his relationship with the former president.

That same day, Trump allegedly called De Oliveira and said he would get him an attorney.

The big picture: The threat of cooperating witnesses isn't just confined to Trump's classified documents case.

  • Trump's longtime fixer-turned-antagonist Michael Cohen is expected to be the key witness in the former president's hush-money trial in Manhattan, scheduled to begin March 25.
  • Former White House chief of staff Mark Meadows' cryptic silence after his testimony to the grand jury investigating Jan. 6 has stirred fears within Trumpworld that he's a "rat," Rolling Stone reports.

The bottom line: It's not unusual for campaigns to pay for their staff's legal costs, but prosecutors appear to see potential conflicts of interest in Trump's dealings with witnesses.

  • "I know all about flipping — 30, 40 years I have been watching flippers," Trump said in 2018, when Cohen pleaded guilty to campaign finance violations.
  • "If you can say something bad about Donald Trump ... most people are going to do that."

Today's historic, four-count indictment against former President Trump begins with a simple but devastating statement of facts at the heart of the case prosecuted by special counsel Jack Smith:

The defendant, DONALD J. TRUMP, was the forty-fifth President of the United States and a candidate for re-election in 2020. The Defendant lost the 2020 presidential election.

Why it matters: The 45-page indictment — the third brought against Trump in just over four months — goes on to detail a sweeping, multi-pronged scheme by the former president to cling to power through claims of election fraud he knew were false.

  • "The attack on our nation's Capitol on Jan. 6, 2021 was an unprecedented assault on the seat of American democracy," Smith said in a brief statement to the public after the charges were unsealed.
  • "As described in the indictment, it was fueled by lies. Lies by the defendant."

Driving the news: The indictment alleges that beginning shortly after Election Day, Trump perpetrated three criminal conspiracies as he sought to discount legitimate votes and reverse President Biden's victory:

  • Conspiracy to defraud the United States by using "dishonesty, fraud and deceit" to obstruct the counting, collection and certification of election results.
  • Conspiracy to obstruct the Jan. 6 certification of the electoral vote.
  • Conspiracy to "injure, oppress, threaten, and intimidate" Americans in the free exercise of their right to vote and to have their votes counted.

Trump was also charged with obstruction of an official proceeding for his alleged "exploitation of the violence and chaos at the Capitol" on Jan. 6.

Between the lines: The indictment breaks down Trump's alleged plot to overturn the election into five categories:

  • Pressuring state legislators and election officials to subvert the election results with knowingly false claims of fraud.
  • Organizing fraudulent slates of electors in seven states: Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania and Wisconsin.
  • Attempting to use the authority of the Justice Department to conduct "sham election crime investigations" and send letters to battleground states claiming to have identified significant fraud concerns.
  • Attempting to pressure then-Vice President Mike Pence to use his ceremonial role counting the electoral votes on Jan. 6 to obstruct certification of Biden's victory.
  • Exploiting the violence and chaos on Jan. 6 to convince members of Congress to further delay certification.

Zoom in: The indictment alleges that when Pence told Trump on Jan. 1 that he had no constitutional authority to reject electors, the then-president replied: "You're too honest."

The bottom line: Americans may be numb at this point to the seemingly never-ending legal troubles afflicting Trump, who polling shows is running competitively with Biden in a hypothetical 2024 rematch.

  • But unlike Trump's alleged hush money payments and retention of classified documents, this latest indictment strikes at the heart of American democracy — and of the next election.

⚖️ The alleged co-conspirators

The indictment alleges Trump enlisted six alleged co-conspirators — not named in the document and not indicted — in his criminal efforts to overturn the election.

Based on public reporting, they appear to be:

  • Co-conspirator 1: Rudy Giuliani, an attorney who knowingly spread false claims and pursued strategies that official Trump campaign lawyers would not.
  • Co-conspirator 2: John Eastman, an attorney who sought to use Pence's ceremonial role counting the electoral votes to obstruct certification on Jan. 6.
  • Co-conspirator 3: Sidney Powell, an attorney whose unfounded claims of election fraud Trump embraced, while privately acknowledging they sounded "crazy."

The Trump campaign responded to the third indictment of the former president much like it did the first two — crying "witch hunt" and blasting out fundraising emails to its supporters.

  • Rubicon crossed: An unnamed campaign spokesperson claimed "the lawlessness of these persecutions" is "reminiscent of Nazi Germany in the 1930s, the former Soviet Union and other authoritarian, dictatorial regimes."

What to watch: Trump will be arraigned at 4pm Thursday at the federal courthouse in D.C. Smith has vowed "a speedy trial so that our evidence can be tested in court and judged by a jury of citizens."

  • The federal judge assigned to Trump's case is Tanya S. Chutkan, an Obama appointee known for sentencing Jan. 6 defendants to prison terms longer than prosecutors had requested.
  • Florida Gov. Ron DeSantis, Trump's chief rival for the GOP nomination, said in a statement that it's "unfair" to have Trump stand trial in D.C. because he will face "a jury that is reflective of the swamp mentality."

U.S. District Judge Tanya S. Chutkan, selected by a random process to oversee Trump's case, was appointed by President Obama in 2014, Axios' Sareen Habeshian reports.

  • Born in Jamaica, Chutkan received her bachelor's degree in economics from George Washington University and graduated from the University of Pennsylvania Law School.

Chutkan has previously dealt with Trump, denying his 2021 motion to halt records from being turned over to the Jan. 6 committee, writing: "Presidents are not kings, and Plaintiff is not president."

  • She has been one of the toughest punishers of Jan 6. rioters, repeatedly setting longer sentences than requested by the Justice Department.

Pence fought an order to testify but now is a central figure in his former boss’s indictment

NEW YORK (AP) — Mike Pence fought the Department of Justice in court to try to avoid testifying against his former boss. Trump's legal team is teasing a risky defense to his historic third indictment:

  • It's the idea that the former president genuinely believed his own lies about election fraud — despite being told by dozens of his closest advisers, allies and agencies that they were baseless.

Why it matters: If they proceed to trial, Trump's lawyers effectively could be asking a jury to believe that the former president was delusional — undermining special counsel Jack Smith's core thesis that Trump "knowingly" sought to defraud the country.

  • The gambit could prove successful in court, where an already unfurling debate over the First Amendment is expected to play a starring role.
  • Politically, however, the "delusion defense" would force Republicans into the uncomfortable position of defending a candidate who can't be trusted to distinguish reality from conspiracy — and who now wants to be president again.

Driving the news: The indictment details many occasions in which top officials and lawyers explained to Trump that his theories — ranging from dead people voting to machines altering votes to foreign interference — were baseless.

  • As official campaign staffers grew frustrated, Trump increasingly began listening to conspiracy theorists such as Sidney Powell, whose attorneys said in response to a 2021 defamation lawsuit that "no reasonable person" would believe her bizarre claims were "truly statements of fact."
  • "I'll obviously hustle to help on all fronts, but it's tough to own any of this when it's all just conspiracy sh*t beamed down from the mothership," a senior campaign official — who repeatedly told Trump his claims were untrue — wrote in an email on Dec. 8, 2020.
  • Even Trump, the indictment alleges, privately acknowledged in December that Powell's claims about voting machine conspiracies sounded "crazy."

What they're saying: "I would like [prosecutors] to try to prove beyond a reasonable doubt that Donald Trump believed that these allegations were false," Trump attorney John Lauro said on Fox News last night.

  • "No sitting president has ever been criminally charged for his views, for taking a position," he added.

What to watch: Citing the subpoena power that Trump's lawyers will be entitled to in the discovery process, Lauro pledged to "re-litigate every single issue in the 2020 election."

  • In other words, the Trump team may use his criminal trial to once again try to prove there was election fraud — and thereby de-fang Smith's charges.
  • Remember: More than 60 election lawsuits brought by Trump and his allies were tossed out of court in the weeks after the election.

The bottom line: The House Jan. 6 committee hearings last summer gave Republicans a taste of the coming spectacle in federal court. The subsequent defeat of Trump-backed election deniers in the midterms likely has GOP leaders once again bracing for impact.

🏛️ Experts skeptical of Trump defense

Former President Trump's legal team says he's been indicted for actions that are protected by the First Amendment — and that the First Amendment will ultimately exonerate him, Axios' Sam Baker writes.

  • Reality check: Many legal experts say that's not true, and not really the point.

"There's nothing that's more protected under the First Amendment than political speech," Trump attorney John Lauro said on CNN shortly after special counsel Jack Smith's indictment was unsealed.

  • "Donald Trump had every right to advocate for his position … now his advocacy is being criminalized," Lauro said.

How it works: The indictment is focused on Trump's efforts to stop the election from being certified, and alleges those efforts amounted to a criminal conspiracy.

  • "There's no First Amendment right to participate in a conspiracy," said Alan Rozenshtein, a University of Minnesota law professor who previously worked in the Justice Department, and has written about the First Amendment implications of prosecuting Trump for his role in Jan. 6.

To put it simply, if you and I engaged in a criminal conspiracy, and we talked about it in public, no, we couldn't be prosecuted for what we said. But that wouldn't get us off the hook for the underlying crime.

  • No one disputes that Trump had a right to claim he had won the election, whether he believed that or knew it to be false.

The bottom line: The real legal question is whether his actions amounted to a criminal conspiracy. He's not being indicted for what he said.

President Trump is making a habit of turning arraignments — three for three — into free campaign programming.

  • "I NEED ONE MORE INDICTMENT TO ENSURE MY ELECTION," he posted yesterday on his Truth Social platform.

But there were no big, supportive crowds in Washington yesterday like there were in sunny Miami in June, when he was arraigned on charges of mishandling classified documents, Axios' Stef Kight writes.

  • Instead, many anti-Trump protestors gathered around the courthouse, where hundreds of Jan. 6 defendants have been sentenced.

Why it matters: Trump's dour appearance in drizzly D.C. on charges of plotting to overturn the 2020 election seemed to symbolize why the case is considered the most serious he faces.

Trump and his attorneys waited more than 20 minutes in court before a magistrate arrived to hear the former president's not-guilty plea.

  • Magistrate Judge Moxila Upadhyaya addressed him as "Mr. Trump" — which "irked" him, CNN's Kaitlan Collins reported from outside the courthouse. He prefers "Mr. President."

The next hearing in Trump's case was set for Aug. 28 — an indication that Tanya Chutkan, the Obama-appointed judge who will preside over Trump's trial, is open to prosecutors' call for a speedy trial.

  • If prosecutors are able to secure a trial date in early 2024, the D.C. case would be tried before the one in Miami. Judge Aileen Cannon, a Trump appointee, has scheduled a trial for May.
