Trump's new court date

Former President Trump says he's been summoned to a federal courthouse in Miami on Tuesday in the probe over his handling of classified documents, he wrote tonight on Truth Social.

  • "The corrupt Biden Administration has informed my attorneys that I have been indicted, seemingly over the Boxes Hoax."
  • “I'm an innocent man, I did nothing wrong. And we will fight this out just like we've been fighting for seven years," Trump said in a video released tonight.

Trump's new peril

Former President Trump announced his own indictment last night, preempting the Justice Department, which still hasn't commented. He branded it "a boxes hoax — just like the Russia, Russia, Russia hoax."

  • Why it matters: The seven-count indictment — related to Trump's handling of classified documents he took from the White House to his Mar-a-Lago estate in Palm Beach — is the first time a former president has faced federal criminal charges.

The charges carry grave legal consequences, including the possibility of a prison sentence if Trump is convicted.

For former President Trump, the 2024 campaign is more than a race to return to the White House — it's a fight to stay out of prison, Axios' Alex Thompson reports.

  • The documents were marked "FVEY" (Five Eyes), meaning they include intelligence meant to be shared only among U.S. officials and those from four close allies — Australia, Canada, New Zealand and the U.K.
  • The indictment says Walt Nauta — a White House valet and Mar-a-Lago personal aide, who also was indicted yesterday — texted the photo of the spill to another Trump employee.

Dozens of boxes were shown stacked on a stage in Mar-a-Lago's White & Gold Ballroom. Some later were moved to a business center and then a bathroom and shower, the indictment said.

  • With Nauta's help, papers that included classified information allegedly were shuffled between a Mar-a-Lago storage room, Trump's residence and even his summer home in Bedminster, N.J., according to prosecutors.

A wave of anger is spreading through the GOP after the federal indictment of Trump, with online message boards filled with disturbing vitriol and law enforcement on alert ahead of his Tuesday court date in Miami.

Why it matters: Trump is in the "solidarity" phase of his crisis playbook.

  • With a thoroughly unique skill of surviving the unsurvivable time and again, Trump's team has developed a plan to repeat the plan during times of trouble, Axios' Alex Thompson reports.
  • One part is solidarity: "Even before all the facts are known, Trump has his allies hit the airwaves to claim that he is innocent or his enemies are corrupt."

What's happening: In his first public appearance since the 37-count indictment over his mishandling of classified documents, Trump framed his legal peril as a collective fight.

  • "In the end, they’re not coming after me, they’re coming after you — and I'm just standing in their way," Trump said Saturday at a rally in Georgia.
  • "This is the final battle," he added, saying "our people are angry.”

Zoom in: Some of Trump's ultra-MAGA supporters have turned to the online forum "The Donald" to openly fantasize about acts of violence, per Rolling Stone.

  • "The Donald" is the same website that helped dream up and promote the deadly Jan. 6th insurrection. It's been kicked off several web servers, including Reddit, for being too extreme and violating various rules.
  • “If they steal the election again why are we talking about anything but dragging the political elite out of their homes and setting them on fire?” asked one user named vax_was_a_bioweapon.

Zoom out: In preparation for Trump's Tuesday court appearance, Miami Mayor Francis Suarez said that he will host a special press conference tomorrow to talk about safety.

  • "We want to make sure that all our citizens know that they're going to be able to express their First Amendment rights, and at the same time we're going to keep them safe, and we're going to make sure that there is no disorder," he said.

What they're saying: Trump's Republican allies on the Hill have been all over the airwaves defending him.

  • "If he wants to store material in a box in a bathroom, if he wants to store it in a box on a stage, he can do it," House Judiciary Chair Jim Jordan (R-Ohio) told CNN's Dana Bash.

Most of Trump's 2024 rivals have dismissed the unprecedented charges by attacking the Justice Department.

  • Florida Gov. Ron DeSantis tweeted that he would "bring accountability to the DOJ, excise political bias and end weaponization once and for all."

It's not just Trump: Republicans across the country are bashing Hillary Clinton, making her a central figure in the 2024 race by renewing their intense criticism of her alleged handling of sensitive information.

Why it matters: It's much harder to run against yourself than a foil — and Trump's federal indictment sets him up for a fight against his own words.

  • "We can't have someone in the Oval Office who doesn't understand the meaning of the word confidential or classified," he said in September 2016.

The backdrop: In his first run for the presidency, Trump constantly railed against Clinton for her use of a private email server — through which she exchanged tens of thousands of emails containing classified material — when she was secretary of state.

Between the lines: Investigators charged Trump for "willful retention" of classified records — a key finding missing from Clinton's case.

  • Then-FBI Director James Comey didn't pursue criminal charges against Clinton in 2016 because investigators didn't find sufficient evidence that she had intended to mishandle the material exchanged through her server.
  • Another crucial difference is that although her email chains included highly classified issues, they weren't classified documents, per the Washington Post, particularly those "with extensive markings and acronyms."

Southern Florida's federal courts are known as a "rocket docket" for their speedy trials. But former President Trump's legal team is likely to unleash a flurry of motions and challenges to delay his criminal trial there, former Trump lawyers tell Axios' Alex Thompson.

A lawyer for Trump's valet accused prosecutor Jay Bratt of improperly bringing up the lawyer's application for a judgeship.
