Why it matters: Special counsel Jack Smith is prosecuting Trump over Jan. 6 with charges of attempting to overturn the 2020 election. State of play: The case has been delayed since March as the Supreme Court weighed in on Trump's claims for presidential immunity. And yesterday's ruling from the high court gave Trump immunity from criminal prosecution for "official acts" taken while in the White House. It still leaves it up to lower courts to determine if most of the criminal acts Trump was accused of in the Jan. 6 indictment are "official" or not. 🔮 What's next: U.S. District Judge Tanya Chutkan — who is overseeing Trump's Jan. 6 case — will determine whether Trump's alleged conduct in the case was protected. If it is, Trump likely can't be criminally prosecuted for them and the charges could be dropped. The bottom line: The Supreme Court's decision makes it all but certain that voters will not know whether the presumed Republican nominee violated the law by attempting to overturn an election. If Trump is elected, he may never go to trial over the alleged criminal conduct, as prosecuting a sitting president goes against current Justice Department policy. In a 93-page ruling, District Judge Aileen Cannon said the appointment of special counsel Jack Smith violated the Constitution. Smith had charged Trump last year with taking classified documents from the White House and resisting the government's attempts to retrieve the materials. He pleaded not guilty. Even though a trial before the presidential election was considered highly unlikely, many legal experts had viewed the classified documents case as the strongest one of the four cases that were pending against Trump. It keeps the same criminal charges but narrows the allegations against him, following a Supreme Court opinion that conferred broad immunity on former presidents. Read more. Why this matters: The stripped-down criminal case represents a first effort by prosecutors to comply with a Supreme Court opinion that made all but certain the Republican presidential nominee won’t face trial before the November election. The new indictment does away with references to allegations that could be deemed as official acts for which Trump is entitled to immunity in light of the Supreme Court’s ruling. The Republican presidential nominee previously pleaded not guilty to the charges, which stem from his attempts to overturn the 2020 election after he lost to President Joe Biden — resulting in the January 6, 2021, riot at the US Capitol. Although Trump was charged with the same offenses as the original case, prosecutors have strategically narrowed the allegations and altered the language to try to comply with the Supreme Court's latest ruling on presidential immunity.
