Members phkrause Posted November 13, 2024 Author Members Posted November 13, 2024 ⚖️ SCOTUS waiting game Illustration: Sarah Grillo/Axios Supreme Court Justice Samuel Alito has no plans to retire, people close to him tell The Wall Street Journal. Some conservatives have questioned whether Alito, 74, or Justice Clarence Thomas, 76, will/should step aside once Trump takes office so younger conservative justices can be appointed. 💡 Our thought bubble, from Axios court watcher Sam Baker: The beginning of a new president's term isn't necessarily the time you'd expect to see a strategic retirement. If Republicans look likely to lose the Senate majority two years from now, or if momentum is swinging toward Democrats in 2028, pressure on Alito and Thomas could grow. But Republicans simply aren't in the same situation Democrats were in when the late Justice Ruth Bader Ginsburg refused to step aside. Alito and Thomas are younger, healthier and more powerful within the court than Ginsburg was. Conservatives have a solid majority and plenty of time to pass the torch if they decide they need to. Members phkrause Posted December 3, 2024 Author Members Posted December 3, 2024 The Supreme Court will hear arguments over Tennessee’s ban on gender-affirming care for minors In its waning days, the Biden administration, and families of transgender adolescents, are turning to a conservative-dominated Supreme Court after a presidential election in which Donald Trump and his allies promised to roll back protections for transgender people. Read more. Why this matters: Most Republican-controlled states have adopted a ban similar to the one in Tennessee, and those laws mostly are in effect, despite legal challenges. The Tennessee case is the first time the nation’s top court will consider the constitutionality of the bans. A lawyer for Tennessee will argue that the “life-altering gender-transition procedures” are risky and unproven and that it’s the state’s role to protect children. There are about 300,000 people between age 13 and 17, and 1.3 million adults who identify as transgender in the United States, according to the Williams Institute at the UCLA School of Law. The fight over whether they can access puberty blockers and hormonal treatments is part of a broader effort to regulate the lives of transgender people, including which sports competitions they can join and which bathrooms they can use. Trump nominated three justices in his first term who pushed the court in a more conservative direction. Yet one of Trump’s appointees, Justice Neil Gorsuch, also authored a ruling in 2020 that protected LGBTQ people from discrimination in the workplace under federal civil rights law. The Biden administration and families of transgender adolescents both rely on that decision to bolster their arguments. Members phkrause Posted December 5, 2024 Author Members Posted December 5, 2024 Supreme Court seems likely to uphold Tennessee’s ban on medical treatments for transgender minors WASHINGTON (AP) — Hearing a high-profile culture-war clash, the Supreme Court on Wednesday seemed likely to uphold Tennessee’s ban on gender-affirming care for minors. https://apnews.com/article/supreme-court-transgender-health-tennessee-3fd2de125caeac6e323bd81ef7271837? Transgender care The Supreme Court appeared likely to endorse a divisive Tennessee law that bans gender-affirming care for minors after more than two hours of oral arguments on Wednesday. The case — US v. Skrmetti — could determine whether states can restrict puberty blockers and hormone therapy for transgender children and teens. A decision is expected by July 2025. During the arguments, Justice Ketanji Brown Jackson said she was "suddenly quite worried" and "nervous" about conservatives' arguments in the controversy. Republican lawmakers who support the ban say decisions about care should be made after an individual becomes an adult. Opponents argue that in addition to violating the civil rights of trans youth, the laws also run afoul of parents' rights to make decisions about their child's medical care. Members phkrause Posted January 10 Author Members Posted January 10 🕺 Supreme Court's TikTok dance Illustration: Aïda Amer/Axios President-elect Trump's last-minute effort to give TikTok a stay of execution is one more twist in a case that already scrambles every ideological dividing line, Axios court watcher Sam Baker writes. The court is set to hear oral arguments tomorrow over TikTok's future. A new, overwhelmingly bipartisan law requires the app's Chinese parent company, ByteDance, to either sell TikTok by Jan. 19 or shut it down within the U.S. State of play: Republicans in Congress supported the law, which President Biden signed, and GOP attorneys general have weighed in to help Biden defend the law in court. Trump previously advocated for a ban, then flip-flopped. He filed an amicus brief on Dec. 27 urging the court to pause the law. Between the lines: The conservative Supreme Court usually (but not always) sides with people making First Amendment claims. And it usually (but not always) sides with the federal government when the government says there's a national-security issue. In this case, it won't be able to do both.
