⚖️ Corporate America's coming court fights

Any day now, the Supreme Court is expected to roll back affirmative action at universities. The decision could have a domino effect on corporate diversity initiatives:

  • Corporate hiring and recruiting practices could be next in the crosshairs if the justices dismantle affirmative action, Axios' Eleanor Hawkins and Erin Doherty report.

Catch up quick: The high court is weighing whether colleges can explicitly consider applicants' race in admissions.

  • Those in favor believe affirmative action is critical for ensuring diversity. Opponents believe it discriminates against white and Asian students.

🖼️ The big picture: Some conservative organizations have already begun to test the discriminatory argument with U.S. companies.

  • America First Legal filed complaints with the EEOC, asking for an investigation into several companies' hiring practices.

⚠️ "[Companies] should expect some litigation ... based on what we think may happen," Valerie Capers Workman, chief legal officer for recruiting platform Handshake, told Axios.

  • "That doesn't mean that the litigation will have merit. But it does mean that companies will probably have to spend some money defending claims."

Between the lines: Companies could see an uptick in reverse-discrimination claims from employees if the Supreme Court rules against race-conscious admissions, Andrew Turnbull, a partner at Morrison Foerster, told Axios.

  • "When people hear affirmative action has been overruled, they may say: 'Well, why is my company still doing diversity programs?'" said Turnbull, who represents companies on labor and employment litigation.

🥊 Reality check: "Companies do not invest in DEI to favor a certain group of individuals over another group of individuals," said Aniela Unguresan, founder and CEO of Edge Certification.

  • "Companies invest because diverse, equitable and inclusive workplaces are more agile, more resilient and are sustainably more successful."

Supreme Court rejects radical GOP theory that would shred curbs on gerrymandering

The Supreme Court rejected a radical argument put forth by North Carolina Republicans that sought to give nearly unfettered power over federal elections to state legislatures, with Chief Justice John Roberts and fellow conservative Justices Brett Kavanaugh and Amy Coney Barrett joining the court's three liberals to rule on Tuesday that the claims had no merit.

Justices rebuff right

The Supreme Court today rejected one of Republicans' most audacious attempts to control elections, Axios court-watcher Sam Baker writes.

  • In a 6-3 decision, the justices said state election laws can be challenged in court — a rebuke to a burgeoning conservative movement that has sought to block the courts from hearing such cases.

⚖️ State of play: A group of North Carolina GOP lawmakers had asked the court to embrace a sweeping legal theory called the independent state legislature doctrine.

  • The theory holds that state legislatures have total control over their state's election rules, including the procedures that govern presidential elections.

The Supreme Court rejected that argument in one of the highest-profile cases of its term: Moore v. Harper.

  • The Constitution "does not insulate state legislatures from the ordinary exercise of state judicial review," Chief Justice Roberts wrote for the court's majority.

🖼️ The big picture: This case concerned gerrymandering in North Carolina. The state's Supreme Court ruled that new congressional and state legislative maps were "unconstitutional beyond a reasonable doubt."

Supreme Court rejects GOP in North Carolina case that could have reshaped elections beyond the state

WASHINGTON (AP) — The Supreme Court ruled Tuesday that state courts can curtail the actions of their legislatures when it comes to federal redistricting and elections, rejecting arguments by North Carolina Republicans that could have dramatically altered races for Congress and president in that state and beyond.

In high-stakes election case, justices will decide validity of “independent state legislature” theory

The Supreme Court will hear oral argument on Wednesday in a case that UCLA law professor Richard Hasen has called the “800-pound gorilla” of election law. The case, Moore v. Harper, is a test of the “independent state legislature” theory – the idea that the Constitution gives state legislatures nearly unfettered authority to regulate federal elections, with little to no interference from state courts. Depending on whether the justices agree with the theory and how broadly they interpret it, it has the potential to upend federal elections by eliminating virtually all oversight of those elections by state courts.

Separating Spin from Reality in the Supreme Court’s Moore v. Harper Case: What Does It Really Mean for American Democracy and What Does It Say About the Supreme Court?

There’s a whole lot of spin out there about the Supreme Court’s 6-3 decision in Moore v. Harper concerning the scope of the “independent state legislature” theory. To hear some progressives tell it, the ISLT theory is dead and democracy is thriving. To hear it from Jason Snead, head of the Leonard Leo-backed (and Orwellian-named) “Honest Elections Project,” “The Left will cheer today’s ruling in Moore v. Harper, but this is no victory. For the first time, the Supreme Court has ruled definitively that there is a limit to the power of state courts to interpret election law.” Michael Dorf says liberals should just “take the W.

The end of affirmative action

Illustration of a cracked mortar board.

Illustration: Shoshana Gordon/Axios

The Supreme Court's rejection of affirmative action is a watershed moment for higher education, Axios' April Rubin writes.

  • It could decrease diversity in colleges and universities — and eventually the professional world.

President Biden slammed the decision. When asked if this is a rogue court, he replied: "This is not a normal court."

The big picture: The effects of the 6-3 conservative-led decision are expected to be felt immediately.

  • Jerry Kang, a UCLA law professor who has researched affirmative action and implicit bias, says to expect "substantial drops in underrepresented minority representation" during the next admissions cycle.

📉 Racial disparities will be even more pronounced at highly selective institutions, with a drop in Black and Latino enrollment, says Julie J. Park, an associate professor of education at the University of Maryland, College Park, who has studied race-conscious admissions.

  • That lack of diversity will eventually trickle into professional fields, including business, medicine and law, Park contends.

Reality check: Schools may still consider where students live, or other factors, as proxies for race, says Natasha Kumar Warikoo, a professor of sociology at Tufts University who wrote a book about affirmative action.

  • Students will still be allowed to write about their lived experiences with race in their application essays.
