About five years ago the Department of Justice (DOJ), under former President Trump, began an investigation of Hunter Biden, the son of now President Biden.   That investigation has been widely reported in the media as involving major criminal issues, some of which were related to now President Trump.

During the investigation it was determined that on two occasions Hunter Biden had failed to properly disclose his income.  At that time, proper payments, to include fines, were paid by Hunter Biden.   Following those payments, the criminal investigation continued.

Today, June 20, 2023, the DOJ has an end to the criminal investigation.  Hunter Biden will plead guilty to two misdemeanor charges of a failure to properly disclose his income.  In addition,  Hunter Biden will enter a pre-trial diversion program on a charge that he did not truthfully fill out an application to purchase a fire arm.   Under normal procedures if Hunter Biden successfully completes a two year diversion program that criminal charge will be   dismissed.

Under normal circumstances his pleading guilty to  the misdemeanor tax charges would not result in a prison sentence.  But, this will be decided by the judge and not the DOJ.

The other major criminal issues commonly reported by the media are now dismissed.

Hunter's next worry

Hunter Biden has agreed to plead guilty to not paying taxes in 2017 and 2018, and he'll enter into a probation agreement on a charge of illegally owning a gun while being a drug user, according to a court filing by the U.S. attorney in Delaware.

  • Congressional Republicans will continue to investigate him. And he'll only avoid prosecution for his gun felony if he stays drug-free for a set period of time, something he has struggled with in the past.

Former President Trump has said he will appoint a special counsel to “go after” the Biden family if he wins the next election, and several other Republicans running for the nomination criticized the plea deal.

  • If a Republican wins the presidency in 2024, Hunter could be investigated again.

⚡ Catch up quick: The Justice Department charged that Hunter possessed a Colt Cobra revolver in Delaware in October 2018 while “knowing that he was an unlawful user of and addicted to a controlled substance.”

  • The maximum penalty for the gun charge is 10 years in jail and a fine of $250,000.

Hunter was also charged with failure to timely file and pay taxes in 2017 and 2018 when, by his own admission, he was in the throes of an addiction to crack cocaine.

Hunter's Rorschach test

Hunter Biden's guilty plea to misdemeanor tax charges, which will allow him to avoid prosecution on a gun charge after two years of probation, has produced political ammunition for both sides:

  • For Democrats, the charges brought by a Trump-appointed U.S. attorney undermine Republican claims the Justice Department has been "weaponized" against President Biden's political opponents.
  • For Republicans, the guilty plea — which will likely allow Hunter Biden to avoid prison time — is a "sweetheart deal" that reinforces the need for GOP-led investigations into the Biden family's alleged corruption.

Why it matters: Conservative claims of a "two-tiered" justice system are at the heart of the House GOP agenda and former President Trump's 2024 campaign. The timing of Hunter Biden's plea deal — one week after Trump's arraignment in federal court — is likely to super-charge that narrative.

What they're saying: "If you are the president's leading political opponent, the DOJ tries to literally put you in jail and give you prison time. If you are the president's son, you get a sweetheart deal," House Speaker Kevin McCarthy (R-Calif.) told reporters.

  • McCarthy and other Republicans vowed to continue aggressively investigating the Bidens, including unsubstantiated allegations of bribery that they say are far more serious than the tax and gun charges.

  • Unlike Hunter Biden, Trump reportedly rejected his lawyers' proposal to seek a settlement with DOJ to avoid the federal charges he now faces, which include obstruction of justice and violations of the Espionage Act.

Between the lines: Hunter Biden's lawyer Chris Clark told MSNBC that he believes the investigation — which spanned five years — is now over.

  • Clark added he would not have made a plea deal if he believed more charges were coming, including any related to money laundering or foreign business dealings.
  • But U.S. attorney David Weiss said in a statement that the investigation is "ongoing" — a dynamic that will likely complicate the GOP's push to obtain Biden-related documents withheld by the FBI.

What to watch: House Oversight Chairman James Comer (R-Ky.) said he plans to consult with Rep. Jim Jordan (R-Ohio), who leads the weaponization committee, about calling Weiss to testify.

  • In a letter to Jordan on June 7, Weiss said Attorney General Merrick Garland had granted him "ultimate authority" over the investigation, "including responsibility for deciding where, when, and whether to file charges."

WILMINGTON, Del. — Hunter Biden's plea deal on two misdemeanor tax charges fell into jeopardy today. He pleaded not guilty after the judge said she wasn't ready to accept the terms of a revised deal.

WILMINGTON, Del. — Hunter Biden's lawyers were fuming last night after a plea deal to help the president's son avoid prison blew up in a chaotic, three-hour hearing, Axios' Alex Thompson reports from the courthouse.

  • Why it matters: Judge Maryellen Noreika's rejection of Biden's plea deal on tax charges ensures that legal issues will keep shadowing Biden for weeks or months — likely right into the heat of the 2024 election.

🔬 Between the lines: The judge's questioning revealed a disagreement over whether the agreement on the tax charges was linked to a gun charge against Biden.

  • Prosecutors said it wasn't. Biden's lawyers thought it was — and they repeatedly argued about it in open court.

  • At one point, Lowell went over to Justice Department prosecutors and began introducing himself.

A Fox News reporter in the room reported hearing Lowell say: "I'm involved in the fray now. I was hoping not to be."

Hunter heading for trial

Hunter Biden — who came this close last month to neatly wrapping up his legal problems — is now facing the threat of a trial during the heat of his father's re-election campaign.

  • Why it matters: The appointment of U.S. Attorney David Weiss as special counsel in the case included the news that Hunter Biden's plea agreement was at an impasse, Axios' Erin Doherty writes.

At a surprise press conference this afternoon, Attorney General Merrick Garland said Weiss told him the investigation had "reached the stage" where the powers of a special counsel were necessary.

Hunter Biden's lawyer told the Justice Department that President Biden would be a "fact witness" in any criminal trial involving his son, Politico's Betsy Woodruff Swan scoops.
