Judges in some of the nation's most important election battlegrounds have rejected a string of last-minute efforts by conservative and Trump-aligned groups to impose new voting rules ahead of Election Day, Axios' Erin Doherty writes.

  • Why it matters: Even as courts have shot down several of these challenges, election law experts warn that the rejections could be used to promote conspiracy theories and misinformation.

Zoom in: In Georgia, a Trump-aligned majority of the state's election board passed a flurry of rules last month that included a measure to require poll workers to hand-count millions of ballots.

  • Fulton County judges overturned that rule and another that would've allowed county election officials to delay certifying election results merely by citing suspicions of fraud. Republicans have appealed.

🌵 In Arizona, a federal judge blocked an effort that would have required Arizona's 15 counties to check the citizenship of every federal election-only voter.

🎰 In Nevada, a federal judge on Friday dismissed a suit by the RNC and Nevada's Republican Party challenging the state's voter rolls.

🌽 In Nebraska, the state Supreme Court said last week that the state's top election official can't block people with felony convictions from voting after they serve their sentences.

With just 15 days until Election Day, Kamala Harris and Donald Trump are on a campaign blitz through the battleground states as polls show the race remains tight nationwide. Harris on Sunday visited churches in Georgia, part of her campaign's "souls to the polls" push to turn out Black voters. Trump, meanwhile, visited a Pennsylvania McDonald's to work the fry cooker and drive-thru window. He later held a town hall in the key swing state. Early voting also kicked off in Michigan on Saturday — and both campaigns are keenly aware of how a win in the traditional "Blue Wall" state could change the electoral map. Officials in North Carolina and Georgia reported strong early voting turnout so far.

Former President Trump has a slight edge over Vice President Harris in the Peach State, according to The Atlanta Journal-Constitution's final pre-election poll, conducted by the University of Georgia School of Public and International Affairs.

  • Trump leads Harris 47% to 43% among the 1,000 likely voters in Georgia, with 8% undecided, Axios Atlanta's Kristal Dixon writes.

From GPS tracking devices on boxes carrying ballots to counting centers with 24-hour livestreams and big windows for public viewing, officials nationwide are working to boost transparency — and confidence — in the Nov. 5 election, Axios' Erin Doherty reports.

  • Why it matters: The moves — along with pre-election tours and open houses of the counting centers — are among officials' new tactics to try to convince voters elections are fair and secure.

The changes are an effort to counter conspiracy theories surrounding the election — even though granting voters more visibility into ballot counting could foster new conspiracy theories.

  • And there are concerns over whether the efforts to promote transparency could be "weaponized by losing candidates," David Becker, executive director of the Center for Election Innovation and Research, said during a media briefing.

🔬 Zoom in: In Pinal County, Ariz., the state's fastest-growing county, the transparency reboot involves a new $32 million, 53,000-square-foot election headquarters that includes a "fishbowl" (photo above) where members of the public can have a 360-degree view of ballots being processed.

  • Fulton County, Ga., one of several big swing-state counties that could decide the election, moved into a new hub last year with an open floor plan, allowing voters to "come in and observe," said Nadine Williams, director of registration and elections in Fulton.

🌴 In Palm Beach County, Fla., the elections office has a Virtual Elections Experience Tour, where voters can see how the process works, said Wendy Link, the county's supervisor of elections.

Individual Nevadans will have more say over the election than voters anywhere else in the country.

  • Why it matters: Only seven swing states (graphic above) are in play. And even among those, there's a wide range in how much each ballot contributes to a single Electoral College vote, Axios' Neal Rothschild reports.

🧮 By the numbers: Based on 2020 turnout, a vote in Nevada counts for 1/234,229th of an electoral vote. That's 24% more than a vote in Arizona and 37% more than in Michigan.

  • Voters in Nebraska's 2nd and Maine's 2nd congressional districts — the only states that aren't winner-take-all — contribute to a separate electoral vote. But those are more diluted than votes elsewhere in the state.

🔭 The big picture: Democrats have railed against the Electoral College, which has favored Republicans in recent cycles due to the disproportionate power of small states.

  • Hillary Clinton won the popular vote by nearly 3 million votes in 2016 — but lost by a combined 80,000 votes in three swing states that cemented Donald Trump's victory.

🥊 Beyond swing states, voters in low-population states have a much greater influence on a single electoral vote.

  • At 92,000 votes per electoral vote, Wyomingites have the most electoral power, followed by residents of D.C. (115,000) and Alaska (120,000).
  • Those Wyoming votes are 4x more potent than a vote in Michigan, the state with the most diluted vote in the country. Michigan is followed by Florida (369,000), Pennsylvania (365,000) and Ohio (348,000).

The bottom line: While every vote matters, in U.S. presidential elections, some matter more than others.

Election countdown

Vice President Kamala Harris and former President Donald Trump are trying to reach as many voters as possible one week from Election Day. Harris is scheduled to deliver the final major address of her campaign today at the Ellipse — a park just outside the South Lawn of the White House where Trump rallied his supporters ahead of the January 6, 2021, Capitol riot. Trump will be in the battleground state of Pennsylvania, where he's joining an event in Drexel Hill and holding a rally in Allentown. This comes as more than 43 million ballots have been cast across 47 states and the District of Columbia. CNN's most recent national poll found that Harris had a large lead among early voters, despite a virtually tied race overall.

 

Burned ballots

Federal authorities are investigating fires at ballot boxes in Oregon and Washington after hundreds of ballots were destroyed. Evidence from the incendiary devices found at two charred ballot boxes in the Portland, Oregon, area shows the fires are connected, as well as a third incident reported in Vancouver, Washington, on October 8, a spokesperson for the Portland Police Bureau said. Authorities are working to determine the motives behind the attacks that appear "targeted and intentional," the department added. The fires come after the FBI and Department of Homeland Security recently issued a bulletin raising concerns that "election-related grievances," such as a belief in voter fraud, could motivate domestic extremists to engage in violence in the weeks before and after the November election.

Lawmakers in both parties are bracing themselves for a tumultuous period after the Nov. 5 election — with many openly expressing fears of civil unrest and even political violence, Axios' Andrew Solender writes.

  • Why it matters: Democrats see it as virtually inevitable that former President Trump will challenge the election results if he loses.

One House Democrat told Axios they're "extremely" concerned about violence, and hired half a dozen state troopers to provide security at their election night event — a significant boost over past years.

  • Republicans claim the real threat would be from the political left being unable to accept another Trump term.

🖼️ The big picture: Federal and local law enforcement are already ramping up security across D.C. ahead of the election.

  • Rep. Greg Landsman (D-Ohio) told Axios that, when Congress left for recess in September, "What I saw in terms of security was unprecedented."
  • The Capitol Police turned heads Monday night by performing a "casualty evacuation exercise" that involved landing three helicopters in front of the Capitol.

  • Rep. Delia Ramirez (D-Ill.) said she fears violence regardless of the presidential result: "If [Trump] wins, he and his violent supporters will be emboldened. And if he loses, I worry they will be worse than four years ago."

🔮 What's next: While most members' fears were focused on Jan. 6, some also expressed worry about the days after Nov. 5 — when some key presidential swing states are likely to remain uncalled as votes are counted.

  • "There's a new privacy emerging here, where it's far more convenient to either lie or not talk about it," said John Gerzema, CEO of The Harris Poll, which isn't affiliated with Vice President Harris' campaign.

Make a plan

The 2024 election is coming down to the wire, so if you've been waiting until November 5 to cast your ballot, you'll need to be prepared. Check your registration status online. Twenty-three states and Washington, DC, allow Election Day voter registration. Next, know your voting location. The site you voted at two or four years ago may have moved. Be sure to bring a photo ID. Rules differ from state to state regarding what forms of identification are acceptable. Finally, be prepared for long lines at many voting locations — and know that what you are wearing could keep you from voting: several states have electioneering laws that prohibit wearing campaign hats, T-shirts or buttons within a certain distance of a polling location.

 

Battleground states

The Harris and Trump campaigns are focused on corralling votes in battleground states that could determine the election. Recent CNN polls show Kamala Harris maintains a narrow advantage in two of the three "blue wall" states — Wisconsin and Michigan — that collectively represent her clearest path to an Electoral College victory. But the race is tied in Pennsylvania, the largest electoral prize of the three states. In the critical Southwest battlegrounds of Arizona and Nevada, Harris and Donald Trump run near even in the race for the White House. And in Georgia and North Carolina, it's also neck and neck. If the vote count is close in key states, like it was in 2020, we probably won't know the winner on Election Day.

 

Compare candidates

A scant 2% of likely voters say they haven't yet chosen a presidential candidate to support, and another 12% have chosen one but say they could change their minds, a CNN poll conducted by SSRS in late September found. About 41% of likely voters say the economy is the most important issue for them, with protecting democracy second at 21%, immigration at 12% and abortion at 11%. According to the poll, likely voters said they trust Trump over Harris to handle the economy, immigration and foreign policy. On the other hand, likely voters generally favor Harris' approach on abortion and reproductive rights, uniting the country and protecting democracy.

 

Election misinformation

Election officials are hustling to fight misinformation in real time during the early voting process. This comes as conservatives have been sharing uncorroborated instances of machines flipping votes, claims of widespread fraud in mail ballots and suggestions that election officials are subverting the process if it takes multiple days to count ballots. Social media companies have also stepped back from challenging election misinformation, which has turned some corners of their platforms into hotbeds of conspiracy theories. Many local officials said they will communicate with voters directly should any voting issues arise.

From Election Day to Inauguration Day, America will confront a treacherous 76 days in transferring power from President Biden to his successor — putting new stress on the political parties, the legal system and the culture.

This high-stakes period will require something that's in short supply these days — patience. As Jim VandeHei and I warned last month in a column on a "just-stay-calm" strategy, crucial votes may come slowly. But that doesn't mean they're not on the level.

  • Sluggish vote counts could fuel distrust in the election, spark lawsuits and even civil unrest, and paralyze both ends of Pennsylvania Avenue.
  • So you're going to have to throttle your reactions to every outrage on social media — and there'll be plenty. But lots of it will be plain false. And lots of it will be twisted to manipulate your emotions.

🖼️ The big picture: "I felt the same way two years ago, two months ago, two hours ago," Jim told Manu Raju yesterday on CNN's "Inside Politics" when asked about the outlook in the seven swing states. "Nobody has a clue."

  • "It has been within the margin of error in those seven states, literally for two years," Jim added. "Almost nothing has moved the needle collectively in those seven states, or individually in any one of those single states. ... We have been a 50/50 country since 2000."

🔮 What's next: Here are three key dates to watch, starting 36 days after Election Day, as laid out by TD Cowen's Chris Krueger in his "DC Download." All could be flashpoints if the presidential fight drags on:

  • Dec. 11: This is a new national deadline for governors to certify the results of the presidential election and submit their slate of electors. "This year, because of all the lawsuits disputing the results of the 2020 election, there are new procedures in place to expedite challenges," writes American University's Amy Dacey, former CEO of the DNC.
  • Dec. 17: Electors cast a ballot in state capitols to formally vote for president and V.P. Officials in swing states are already preparing for potential disruptions — including unrest ahead of and during these meetings, and possible submission of alternate slates of electors, NBC News reports.
  • Jan. 6, 2025: Members of the 119th Congress, three days after being sworn in, will count Electoral College ballots under the modernized Electoral Count Act, updated in 2022, to try to ward off another insurrection. Objections are still possible, but harder. The revised law makes plain that the vice president is there only to announce the results as president of the Senate, AP notes.

Between the lines: Much more security will be in place at the Capitol this Jan. 6. The Department of Homeland Security has designated the "Counting and Certification of Electoral Votes" as a National Special Security Event, like the inauguration, the national conventions and the Super Bowl.

The bottom line: There's more turmoil — and testing — ahead.

The claim: Presidential election results aired during Formula 1 race are evidence of 'cheating'

"How does ABC 'accidentally' show the Presidential election results for Pennsylvania with 100% of the votes counted and Kamala Harris won by 5%?" reads text on the image, which is a screenshot of a post on X, formerly Twitter.

The Instagram post's caption reads, "Cheating already. Here we go again! Do you think this will be an honest election?"

Our rating: False

This isn't evidence of electoral fraud or "cheating." An ABC affiliate in Pennsylvania said it mistakenly aired mock results for the 2024 presidential election while preparing for Election Day coverage. A spokesperson for the Pennsylvania Department of State also said the results were not real, as mail-in ballots haven't yet been counted in the state.
