Stan Posted July 11, 2008 Posted July 11, 2008 SARNIA — An Ohio soldier and a California prison guard, charged with bringing guns into Canada on the Blue Water Bridge, would face tough new jail terms if convicted under the changed federal gun law. Change effective May 1 call for mandatory three-year jail terms for offences, including possession of prohibited firearms with ammunition. The former minimum penalty was one year. The men were separately charged over the past week, the first Americans charged under the new law in Sarnia. In both cases, handguns were seized. In one case, two loaded handguns were found in the vehicle’s console. A long gun was also seized. In the other case, a handgun was found in a backpack with boxes of ammunition. Switchblade knives were seized in both cases. Parliament’s intention is clear and three years is what the two U.S. residents would face, federal prosecutor Michael Robb said Thursday. The men were being held in custody, awaiting bail hearings. Under the new law, a justice of the peace must consider the increased penalty when determining if an accused should be released. A U.S. citizen charged under the former law was released on bail recently after friends and family posted $10,000 in Sarnia court. Visitors to Canada are routinely given chances to declare their guns at the border. The Tackling Violent Crime Act also increases mandatory jail sentences to five years for gun use during an attempted murder, kidnapping, robbery or sexual assault. Stan Posted July 11, 2008 Author Posted July 11, 2008 At the closest border crossing where I live, there was a rented car from, AVIS or BUDGET or one of those that, was seized as the drivers lied about firearms. They laughed and said "you can not take that car, it isn't ever mine it is AVIS or whatever. And they said, perhaps you can buy it back for them at the auction of seized goods. The laughter quit.
