Interestingly, he’s been using the title Commander in Chief lately to push, prod, pull, and twist – to implement his agenda; however, as I recall – according to the Constitution, the POTUS is Commander in Chief only upon the Declaration of War by Congress. It’s been quite awhile since Congress has declared War. Then again,

the Declaration of War by Lincoln has never been sunsetted – allowing succeeding POTUSes unusual powers.

That ain not kosher!

Be that as it may, Panetta gives clue to the Administration’s thinking in that he accedes to the dictates of the UN – rightly so, as our Constitution concedes that Int'l Treaties supercede our Constitution – and we do have an Int'l Treaty with the UN.
