Members phkrause Posted April 22, 2013 Members Posted April 22, 2013 Many people believe that if they are arrested and not "read their rights," they can escape punishment. Not true. But if the police fail to read a suspect his or her Miranda rights, the prosecutor can't use anything the suspect says as evidence against the suspect at trial... http://www.nolo.com/legal-encyclopedia/police-questioning-miranda-warnings-29930.html Quote phkrause When the righteous are in authority, the people rejoice; But when a wicked man rules, the people groan. Ted Oplinger Posted April 23, 2013 Posted April 23, 2013 Thanks for providing the link. My reference earlier (on another thread) about a perpetrator getting off on a Miranda technicality, was in the event the police DID use the suspect's own words and Miranda was found to be relevant to the case. I should have been a little more wordy to explain my concern...but people say I am already wordy enough... Blessings, Quote "As iron sharpens iron, so also does one man sharpen another" - Proverbs 27:17 "The offense of the cross is that the cross is a confession of human frailty and sin and of inability to do any good thing. To take the cross of Christ means to depend solely on Him for everything, and this is the abasement of all human pride. Men love to fancy themselves independent. But let the cross be preached, let it be made known that in man dwells no good thing and that all must be received as a gift, and straightway someone is offended." Ellet J. joeb Posted April 23, 2013 Posted April 23, 2013 I think I knew a Miranda once, but I didn't think she had special rights..... Quote Liberty cannot be established without morality, nor morality without faith.Alexis de Tocqueville

Ted Oplinger Posted April 25, 2013 Posted April 25, 2013 Actually, I thought it was a nice, brief side thought complimenting the OP...
