Early morning, Wednesday, January 1: The sale of recreational marijuana, within specific limitations, becomes legal in Colorado.

Early afternoon, Tuesday, January 2: A two year-old child arrives at the emergency department of hospital. Mother states that the child is lethargic and acting oddly. Toxicology tests demonstrate the presence of THC, an active ingredient in marijuana, in the urine of the child. mother states that earlier she had discovered the child eating a cookie that the child had found outside the family home. The mother is fully cooperating with the police investigation and a police search of the home has not turned up anything.

NOTE: With the legalization of the sale of recreational marijuana in Colorado, food and drink is being sold that contains MJ as an ingredient.

I got drunk off of a glass of turpentine that was sitting out at my moms art club when I was 3. Should turpentine be illegal or should people just be more aware and responsible?

Should alcohol and tobacco be sold anywhere?

How to Celebrate the New Year Safely

By MADD | December 30, 2013

Each year, more than 10,000 people are killed in drunk driving crashes and the risk of sharing the road with a drunk driver is even higher on holidays, like New Year’s. In fact, New Year’s Day is the most dangerous day of the year for drunk driving on our nation’s roadways.

What should be done to a person who is under the influence of THC and causes the death or crippling injury to someone?

i think this is a question for the court to determine. every situation is unique.

There are so many variables to consider in each situation. History of the relationship, emotional state, mental health issues... whenever anyone has caused harm they evaluate intent, negligence, culpability, and more in measuring out the consequences.

the same when alcohol is involved... it is seldom just inebriation that is in play. we cannot take this apart and give an easy answer to every situation by what you described.

judgement is not effected exactly the same way with MJ as it is with narcotics and or alcohol, prescriptions medications or other inebriating factors.

The same thing that should be done to someone that causes the death or crippling injury to someone while under the influence of a Doctor prescribed pharmaceutical narcotic.

i am in Washington and we got the legalization along with Colorado.

we have not opened to shops to sell it in my community. But it is being planned. they are slow in getting that going.

i think it is not making much difference to have changed the law.

those who use do and those who don't use don't.

Do the variables really matter? If you maim or kill someone under the influence of anything, the damage is done. Unless a person is mentally ill, taking the substance is a conscious choice.

The man that killed my sisters was simply celebrating Memorial Day without any intent to harm. Untold harm and heartache was the result

The same thing that should be done to someone that causes the death or crippling injury to someone while under the influence of a Doctor prescribed pharmaceutical narcotic.

A Dr prescribed narcotic is not prescribed to have a good time.

Some Dr's prescribe them to easily but generally a need is perceived. Directions and warnings given. Not all respond the same way to prescription drugs and it would be impossible to predict while trying to help the patient.

My brother and I are on the same prescription, different dose.

My dose is twice what his is and he outweighs me by more than a 100 lbs. The dose I am on knocked him flat and for me it barely does the job intended.

Drugs and alcohol for recreational purposes are a whole different ballgame.Your recreational choices can easily end the life of others without any medical reasons involved in consumption

marijuana is not a narcotic.

marijuana use or alcohol use does not make anyone less responsible for their actions.

but there can be extenuating circumstances, each case is individually dealt with in the court.

What circumstances? You drink or use drugs do so in a safe environment. If you choose not to pay the cost.

You harm or kill someone because of your decision to use recreational drugs and have unexpected reaction, you are responsible and hopefully are given free bed and board, compliments of the state

http://www.ehow.com/about_5046132_driving-under-influence-drugs.html

The Law

Driving under the influence of drugs is generally referred to as DUI ("driving under the influence") or DUID ("driving under the influence of drugs"). In many states, including California, New York and Massachusetts, the penalty for driving under the influence of drugs is the same as driving under the influence of alcohol. Vehicle Code section 23152a states the specific law discussing driving under the influence of drugs. It says, "It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle." Although a police officer is able to test the BAC, or blood alcohol concentration, of a driver who has been drinking, there is no such measure for a driver under the influence of drugs. Consequently, the suspect is generally forced to take a chemical test, or their license can be suspended for an indefinite amount of time, generally 120 days or more. In addition, if drugs are found when a police officer pulls over a car, the vehicle can be seized and impounded.

Facts

In a 2007 poll, it was reported that 31.7 percent of all traffic deaths involved the use of alcohol and/or drugs. Over 12,998 people will killed by intoxicated drivers in 2007 alone, and while it is unclear how many of those deaths involved drugs as well as alcohol, it is estimated that a third of the victims had been smoking marijuana or harder substances, including heroin or cocaine, prior to the accident. A 2008 report states that three out of every five people will experience a substance-related accident in their lifetime.

Bonnie,

i don't know what circumstances, each case is dealt with individually.

i am not familiar with a single case, i do not know any specifics of these kinds of cases. but any case that comes to court is addressed individually this i do know.

i imagine things like age, development, mental condition, relationship to victim.... i have have family members in the law profession, but i don't get into specific cases.

i don't think just one factor determines the outcome of most cases.

Story seems extremely dodgy... who drops their expensive pot brownie and doesn't pick it up? Seems more likely the child was either (a) given some by parents or friends and a story concocted or (B) ill with something else but had acquired THC from secondhand smoke.

Will go for a dig...

Also, the story in the OP speaks of 'Wednesday, January 1' and 'Tuesday, January 2', for a start.

Are we sure this story isn't from a satire site like The Onion or the Daily Currant?

Do we have an example of a single such incident? I seem to recall evidence that marijuana driving (while still not to be condoned or encouraged) was *far* less dangerous than driving under the influence of alcohol.

Before someone starts, no, I don't use weed. At all.

I just care about the truth.

It is my understanding from a comment made in a public magazine maybe 7-10 or more years ago that when driving any major highway, one out of five or eight drivers is driving while drunk.

Not just drinking while driving but driving drunk. It seems a person ought to be able to choose to kill themselves on the highway but often the damage in an auto accident claims the lives of innocent people while the drunk driver walks away with negligible or no injuries.
