Colorado Courtof Appeals Rules

NOTE:  In a unanimous decision issued this morning, the Colorado Court of Appeals ruled that a Lakewood Bakery unlawfully discriminated against David Mullins and Charlie Craig by refusing to sell them a cake for their wedding reception.

According to the opinion, “Masterpiece remains free to continue espousing its religious beliefs, including its opposition to same-sex marriage. However, if it wishes to operate as a public accommodation and conduct business within the State of Colorado, CADA prohibits it from picking and choosing its customers based on their sexual orientation.”

When businesses and other institutions that serve the public have sought exemptions to laws barring discrimination based on sexual orientation and gender identity, the courts have held that businesses are required to comply with antidiscrimination laws. The courts have ruled without regard to whether LGBT people could have obtained the goods or service elsewhere.  Instead the courts have recognized the harm to equal opportunity if lesbian and gay people can be turned away from businesses otherwise open to the public because of who they are.

Phillips admitted he had turned away other same-sex couples as a matter of policy. The CCRD’s decision noted evidence in the record that Phillips had expressed willingness to take a cake order for the “marriage” of two dogs, but not for the commitment ceremony of two women, and that he would not make a cake for a same-sex couple’s wedding celebration “just as he would not be willing to make a pedophile cake.”

Folks:  If you want  to operate a public business you will be required to abide by the law.

The owner of the bakery states that he will appeal to the Colorado State Supreme Court.

This story demonstrates what could be just the beginning of government-mandated morality.  It is a sad development.  Whether or not I agree with the stance Phillips is taking, the fact is that they are taking away his rights to religious freedom.  If he's willing to lose business and money because of his religious convictions, so be it.  Let gay couples go elsewhere for their cakes.  It's not like Phillips bakery was the only game in town.  I'm on his side from a religious liberty point of view.  His stance on gays is immaterial at this point.  His constitutional rights are being violated.

Then there will be no violation of Religious Freedom in this particular case.

Grace is not violating someone's personal belief. Jesus never compromised with what He considered wrong. The gay community is saying that someone's religious belief  should be compromised. While there are many that would not have a problem with this issue,what right to you have to force someone that feels strongly. It is law but the people being sued by "gays/lesbians" seem to be very willing to live their beliefs,even losing their businesses

There will come a day soon when state law demands we go along or stand firm for our beliefs. How many will be as firm as the numerous people being sued.
