It should be noted that this pastor has been charged with a misdemeanor offence of annoying or molesting a child.  Some will wonder what this could be.  In California, this is a charge under section 647.6 of the Penal Code. Violation of this statute  does not require any physical contact.  Language/words that are of sexual content may be enough to convict.   Violation of the statute may also occur by visually exposing the child to sexual activity by others. Generally, but with some exceptions, the child must be under the age of 18 years. 

As is common in criminal law, the statute in this case does have gradations.  But, the penalty for conviction can include up to one year in jail and/or a fine of $5,000.
