It Is the Law, Do You Know It?

Carlos is NOT a citizen of the United States who is legally living in the U.S., but does not have a Green Card.  He is 30 years of age.  Under current U.S. law, which of the following could it be legal for Carlos to do?  [NOTE:  Everything else would be illegal for Carlos to do.]

a)  Vote in a national election.

b) Vote in a local election.

c)  Pay for an advertisement that urged people to vote one way in a national election.

d)  Pay for an advertisement tha urged people to vote one way in a local election.

e)  Give a candidate for national office a contribution.

d)  Give a candidate for a  local office a contribution.

Do you know what the U.S. law actually allows and does not allow?

I'll take a crack at it.

 

Carlos could legally:

D - I think you meant "F") provided it's not an "in kind" contribution.

E) provided it's not an "in kind" contribution.

"B")

Carlos can NOT vote in National AKA Federal  Elections due to the IIRIR-Act (as of April Fools day 1997).

CLUE:

 

1)  With one exception everything on my list is always illegal (in violation of the statute).

There  is one exception that sometimes is illegal and sometimes is legal.  I have not made the statement that would tell you whether or not Carlos meets that exception.  So, you do not know.

Can anyone guess which one is sometimes legal?

2)  AS an additional clue, look up the current litigation involving a Ravi Singh.

The answer is:

"b"  In some places Carlos could vote in a local election, but he could not vote in every local election.

However, under Federal law, Carlos could never do anything to influence an election, even in places where he could vote.  

Does that make sense.

Well, the Ravi Singh litigation says it does not make sense and that litigation is attempting to have the Federal law declared unconstitutional.
