I think this is the case I have been following with the Mennonite that quit working for the post office because they were not willing to accommodate giving him Sunday off. From what I read, the Court may kick it back to the lower court after redefining "undue burden" as substantial additional costs on the employer. In a message I sent to one of the attorneys on the case, he said that he would consider that a victory. One thing some of the justices were concerned about is that giving someone a day off for worship could have a negative impact on morale and that can be understood as an undue burden. My problem there is that hiring a lot of minorities like Spanish-speaking immigrants or Muslims that were a headdress, can also have a negative impact on morale.
