Somali pirate arrives in NYC, awaits court hearing

NEW YORK – The sole surviving Somali pirate from the hostage-taking of an American ship captain arrived in New York on Monday, smiling for a gaggle of cameras and reporters as federal agents led him into custody to face charges in the attack.

Abduhl Wali-i-Musi (AHB'-dul wahl-ih-MOO'-sih) was handcuffed and had a chain wrapped around his waist. His left hand was heavily bandaged from the wound he suffered during the skirmish on the ship two weeks ago.

The smiling teenager seemed poised as he entered a federal building in a rainstorm, but he didn't say anything in response to reporters' shouted questions about whether he had any comment about the pirate episode.

Wali-i-Musi is the first person to be tried in the United States on piracy charges in more than a century. He was flown from Africa to a New York airport and taken into custody ahead of a court hearing Tuesday.

A law enforcement official familiar with the case said that the teenager was being charged under two obscure federal laws that deal with piracy and hostage-taking. The official spoke on condition of anonymity because the charges had not been announced.

The teenager's arrival came on the same day that his mother appealed to President Barack Obama for his release. She says her son was coaxed into piracy by "gangsters with money."

"I appeal to President Obama to pardon my teenager; I request him to release my son or at least allow me to see him and be with him during the trial," Adar Abdirahman Hassan said in a telephone interview with The Associated Press from her home in Galka'yo town in Somalia.

The age and real name of the young pirate remained unclear. The mother said he is only 16 years old and is named Abdi Wali Abdulqadir Muse. The law enforcement official says he is at least 18, meaning prosecutors will not have to take extra legal steps to put him on trial in a U.S. court.

His worried family asked the Minneapolis-based Somali Justice Advocacy Center to help get him a lawyer, said the organization's executive director, Omar Jamal.

"What we have is a confused teenager, overnight thrown into the highest level of the criminal justice system in the United States out of a country where there's no law at all," Jamal said. Wali-i-Musi speaks no English and may never have attended school, he said.

The suspect was taken aboard a U.S. Navy ship shortly before Navy SEAL snipers killed three of his colleagues who had held Capt. Richard Phillips hostage.

The U.S. officials said the teenager was brought to New York to face trial in part because the FBI office here has a history of handling cases in Africa involving major crimes against Americans, such as the al-Qaida bombings of two U.S. embassies in East Africa in 1998.

Ron Kuby, a New York-based civil rights lawyer, said he has been in discussions about forming a legal team to represent the Somalian.

"I think in this particular case, there's a grave question as to whether America was in violation of principles of truce in warfare on the high seas," said Kuby. "This man seemed to come onto the Bainbridge under a flag of truce to negotiate. He was then captured. There is a question whether he is lawfully in American custody and serious questions as to whether he can be prosecuted because of his age."

The first piracy charges in 100 years are being charged in Federal Court today against this Somalian teen.

I hope they throw the book at him and make him an example.

When did the word "pity" take the place of common sense and actual christian responsibility for this young boy.

When the lawyers get done and he goes on his merry way,where do you think he will go.

His lack of skills and education surely will have left him with only one choice. Piracy and murder eventually was really the only thing he could do.

If the US had done more they wouldn't hate the US. Tell me again why we are providing him with legal counsel? I thought that was a right and privilege of US citizens,not those holding US citizens for ransom.

Maybe his buddies could fork over some of their previous ransom "Donation"

Yes. But the sentence should weigh the 'making an example' need. The Judge does this when handing out punitary or monitary punishment during sentencing.

Yes I agree with you. But what happens if they find him innocent? I think bonnie has a good point. He will go right back to his friends and he will continue to help his friends in attacking ships and holding them hostage. Don't you remember what happen when we went into Iraq and the american soldiers captured and than allowed the Iraqis they caught free? The next group they fought had the same guys, they just let go, fighting them again. That's when they started putting them in these make shift prisons, and than they started sending them to bigger prisons and the real top guys they sent on to gitmo.

Unfortunately, that's the cost of justice. It's the same with criminal justice. If someone is found not guilty of a crime, they have to be released. This is no different. You can't imprison people on suspicion, or on the basis of what they might do in the future.

If the guy gets off ... it will not look good for Obama. Why bring the pirate to the US and give him all the privileges of an American citizen? This is why Gitmo was a good concept.

Believe it or not ... this pirate is just a terrorist raising money for terrorist groups. It ends up in Iraq or Afghanistan.

Unfortunately, that's the cost of justice. It's the same with criminal justice. If someone is found not guilty of a crime, they have to be released. This is no different. You can't imprison people on suspicion, or on the basis of what they might do in the future.

This is not a common criminal that assaulted someone or robbed a convenience store.

This is not "you can't imprison people on suspicion". He was not on the boat to get acquainted with the captain. He kidnapped him,threatened his life, and from the sounds of things he is now whining. Tearful because he was afraid he could not practise his religion. Let his friends provide the dollars to pay for his legal costs. Use up a little of that ransom money they have been collecting. Now we get to pay him for holding a US citizen captive and demanding payment for his life

If not tough,put him before a judge and sentence him.

The poverty will be central to understanding this por young man's plight. He was almost forced into this.

Poverty has become the new terminal illness that has no cure except to take from one and give to those that demand you cure their "illness"

Your are right.Maybe you believe this thug should have freedom but I don't think that was what our founders had in mind.

And I would like to see it remain that way.

Justice?? Who has denied this little thug justice? We even get to pay for his legal counsel. There are a lot of somalia that would agree america was a beacon for them.

Almost forgot,they are paid simply because they are here and breathing.

They do very well. And as many times happen charity and living on the dole has less than the hoped for results.

We have several large groups in our small towns.

You know what they like to do? Attend the townhall meetings. Then whine and cry because it is time for their prayers and that is not being respected because of the time for evening prayers.

Each family gets an allotment of 5,000.00 for medical care per year.

Food stamps and a very generous payment for subsidized housing.. 750.00 per month for a family with 4 children. That leaves then 150.00 a month to pay. Guess what, those greedy americans won't pay it all.

It gets really tiresome to hear always how terrible america is.

I just wish it wasn't so much hot air, and they really hated us, maybe they would leave. They could try australia.

Let's all remember that God loves this young man and died for him. It's easy to talk big and tough, but none of us really knows what lengths we would go to when in a desperate situation. Probably none of us knows what it is like to grow up in a lawless society.

Yes carolaa agreed God loves him and died for him. But at the same time he needs to pay for what he has done here on this earth. You reap what you sow. Or my favorite one if you can do the crime than you can and should do the time.

This man or boy doesn't matter which one people consider him, should spent time in jail for what he has done.
